The prosecutor's office files the paperwork with the court to initiate a criminal case. The prosecutor's office then represents the "People of the State of Michigan" throughout the time the criminal case pends before the court. If the prosecutor's office says it's not filing these cases, then these cases have no way of getting into court in the first place.

The only possible exception I can think of would be if a city had an ordinance that was violated, in which case a city attorney could start a case alleging a violation. But, as a practical matter, it's extremely unlikely a city is going to pay a lot of money to a city attorney (most of whom are private attorneys paid by the hour) to bring such a case, against such a minor violation.

Thank you for the reply. I think I understand now. Wayne and Washtenaw County court systems looks to be quite different. In Wayne County, every city has their own District Court (27 of them). Washtenaw County appears to have only two district courts (14th and 15th). I can see now how my "hypothetical" was nothing to worry about.

So here's a question for anyone in the know. This is a "policy" from the Washtenaw County Prosecutors Office to "decline" to prosecute violations of an existing law, NOT an actual change of the law (but still a good thing). I'm curious, is there anything that prevents an individual city court (within Washtenaw County) from prosecuting? I'm guessing there's at least one holier-than-thou City Prosecutor or Judge who says, "I don't care what the County does, I don't report to the County, and I'm going to follow the law".
