    Ability. Opportunity jeopardy. The police had the right and obligation to terminate brooks when he punched one or both of them. The removal of the taser only added to his level of dangerous. Brooks took a very simple dui arrest and turned into a major incident.     Yes, he fired a lethal weapon at the police officers. Now you may want to argue that it could not fire a 3rd time but I contest that law enforcement should not be required to remember when being shot at just how many shots a weapon has discharged.
