You are correct that the charge is unlikely to stick. But my point was to do your best to not get arrested in the first place, so I do not agree with you about staying silent. Clamming up totally might piss them off, being evasive same thing. Saying stupid shit like "I have a right to refuse your questions" is really bad.

As I said, always have a good excuse, and never stray from it. Be polite. I cannot believe how many idiot guys fall for the standard police question "C'Mon., it is best for you to come clean with me and tell me the truth, we will go easy on you if you tell us you picked up this girl for prostitution ".

I agree and disagree with your advice. I do agree to do our best not to get arrested. That is a given.

Before a stop is made the officer is on the radio saying where he / she is and why they are stopping a person. The tag number and vehicle description is also given. If the officer has just cause they will explain why the person is being stopped. While the officer is talking with the driver, the tag, vehicle, and owner information is being run if it already hasn't been. That's to see if there are any outstanding warrants.

A case in point, I was stopped two weeks ago at Clearfield and Kensington. The officer approached my vehicle and stated " the reason you are being stopped is because your left headlight is out". He went on to say "don't worry you aren't getting a ticket. Just get it fixed as soon as you can". So ticket or no ticket that was just cause. He did not ask why I was there or what I might be doing.

Any time a person is stopped by the police there has to be just cause. For them to stop or arrest a person simply because they pissed the officer off is illegal. Like it or not that's the law of the land. An officer does have a right and duty to stop anyone. Just not for any reason. I wouldn't take that right from them for all the tea in China. It protects the police and the public.

As for remaining absolutely silent I don't recommend anybody do that. As you pointed out it can be more trouble than it's worth. Yet there are respectful ways to maintain your right of privacy without being disrespectful or Johnny Street Lawyer.

When pulled over the only question that need be answered is to provide the officer a valid license containing a valid address, registration, and proof of insurance. Any other questions pertaining to anything else would be to clarify if you can be arrested. That is the intent of the officer if you are stopped with or without just cause. If asked if the driver was trying to pick up the woman walking ten yards ahead of them, a protective response would be, "With all due respect I don't wish to discuss that matter". It shows the officer you are not ignoring them and you did indeed hear them. Or I didn't notice a woman. I pulled over to make an important phone call. Am I in a no stopping zone? If so I'd be more than happy to pull up more.

Don't ever fall for the be honest and I'll go easy on you line. The officer does not have the power to go easy on anybody. That falls upon the prosecutor and the judge. The officers sworn duty is to gather as much information against a person as possible. Then present that information to the prosecutor who decides whether to proceed to trial or not. So don't send yourself to court by saying the wrong thing to them. A famous line used by police in Philly is "What do you think, I'm stupid"? When they stop someone without just cause they are on a fishing expedition. Let them fish. Just don't bite.

Had the officer asked me what I was doing I had a few options. 1. I could have asked what that might have to do with my headlight being out. Of course that might have garnered me a ticket. 2. A very simple response for me would have been I'm going to pick up a headlight replacement bulb as we speak. 3. I'm on my way to the El stop to meet a friend that needs a ride. It's really cold out. 4. I'm on my way to Front and Cumberland to help a friend that needs a battery jump. (Knowing in my head that is a different district and the officer probably wouldn't pursue the issue any further). These are all very legitimate reasons for any citizen to be on the street without divulging why they are there.

As stated by myself and the above author the key in any police encounter is to always remain respectful. They are like the rest of us. They have a job to do to support their family. Let them do it without hassle. When people are showed respect they tend to show respect. Never play the officer for a fool. Only a fool would do that. They deal with a lot of crap all day from real tough guys. They don't need any more from wannabe tough guys.

Maintain your vehicle. Follow the rules and laws of the area. Just don't open yourself up to be stopped. Don't always follow the same path over and over. Switch it up. Slide over a couple streets to the left or the right. If you pull over and you think you might be stopped, if there's a store head for it and buy a pack of chewing gum. Or look under the vehicle as though something is wrong. If approached by an officer say you pulled over because off and on it sounds like something is being dragged. Self preservation should be your goal every time you go out. Me, I'm just an 'OL Gator.

It's outrageous that this type of thing is happening. A few years back I stopped and simply offered a girl a ride. The girl freaked out and called the cops. LE pulled me over, handcuffed and questioned me. They threatened to arrest me. Now mind you that offering a girl a ride is legal and there is case law to support this. The best thing to do is remain silent if a cop pulls you over. If you are arrested hire a aggressive lawyer that will file a bunch of motions. At your arraignment plead not guilty and ask for a jury trial. There is a good chance the city attorney will drop the case.

It's around 2:30 this morning and I come down under the el and see a WSW that I seen so turned around and pulled over on sedgely on the corner which I didn't see any other cars around which I wouldn't normally pull over on that side since its too open to be seen picking someone up but lesson learned anyway I wait til she walks around the corner and she gets in thin build but nice ass glasses so before I can pull off a black Chrysler minivan older one pulls right in front of me he got out chubby white guy with a goatee regular clothes tells the girl to get out asks me do I have a wife and kids which I said no then starts the do you want your family to know you're trying to get your dick sucked blah blah the girl gets out asks him for a badge arguing then says he has my tag number he's going back and forth with her then pulls out his phone recording her so then she's like your not a cop mind your business then he says get back in the car then I'll follow you around all night so I back up and leave obviously he wasn't a cop trying to police the neighborhood of prostitution. Guys just be mindful if you're out in the late night hours for this idiot.

This is very true. I have been mongering for over 30 years. Never been hauled off to jail, but realize it could happen. I have been stopped countless time, cuffed, searched, threatened, you name it, but never fully arrested. I see from time to time guys on USASG talking about either being coy with the police and / or suggesting to tell them you are within your rights to not answer their questions. This is stupid; police can arrest you and throw your a $$ in the clinker for any reason whatsoever. If this happens simply because you pissed off the cop, yeah, charges will likely be dropped, but that doesn't stop them from locking you up and making your life miserable. The main issue I have been stopped repeatedly is for being an old white guy in a decent car late at night in "bad neighborhoods". In other words, racism. Most of the time, they assume I am looking for drugs, not poontang. I made the mistake only once of not allowing them to search my car. Took about 4 hours for the K9 dog to show up, then it immediately didn't signal, took them another hour before letting me go.

Always have a good story of why you are there. These days, I say that I am an investor, I buy abandos and distressed properties in bad areas, and scope the areas late at night to get a flavor of what the neighborhood is really like. This has worked very well lately.

Was reading through some history here over the weekend, and recalled an unfortunate event from almost 20 years back. It's relevant and worth sharing, as it still may save any one of us some headache. Back in 1998 (I was fairly local to Kensington avenue, and knew people all over. It was essentially my intro to all of this, and in the days before Internet forums most lessons were learned personally, the hard way. On my way across Kensington (west to east on Oxford), not actually looking for anyone, the police had the street blocked pulling some guy from his car. I had to turn north on K, and found Columbia blocked by police also. I went around the block not wanting to go farther north, and caught sight of a beauty on some side street corner and slowed to see if she was looking. That is all, no words exchanged, nothing. Police at the corner pulled me over, from the car, cuffed, and into a schoolbus in less than 3 minutes. Guess what? At the time, going around the block to look at a SW was considered intent to solicit. Legal or not, that was the reason they used to lock you up on a Friday night. And by Sunday morning, rather than be held for trial, everyone takes a plea deal, pays a fine, and the cops meet quota damned fast. The bus was full in two hours, though I spent about 30 at the round house. Only lucky thing was that the cops couldn't drive stick to move my truck, and their tow truck must've forgotten about it, as it was the only ride they didn't impound. Since then, I've been pulled over here and there for various stupid crap. Make absolutely sure that you are legit. ALL papers in order and up to date, no warrants, open containers, visible stuff you're not supposed to have, etc.

And know that just because maybe you didn't actually do anything, that doesn't matter if the cops don't care.

About 3:30 am this morning I'm driving down jasper and get to huntingdon and see a WSW that looked way to good to be a SW but considering the time of morning I took a chance she's thin but cute huge rack which you can tell she had work done which she admitted and had her lips done dark hair pass the shoulders had a tramp stamp on the back looked like stars nails done. So I drive away from Jasper on to lehigh before I ask anything. Find a dark side street she wanted $40 for head but I offered $25 and she took it so she gets to work and she has skills, was'nt long before I bust and she swallowed the kids. She says she's from nj and doesn't come out often and has regulars she has and just had a baby. She definitely is a upgrade from the regulars but didn't get a chance to ask for the number since she wanted to be dropped off on emerald so I knew what that was about but would repeat if I see her again.
