    The fantastic UNC Chapel Hill Law School professor Jeff Welty wrote an article about this. The short form answer is that LEO could apply its obscenity or prostitution laws to arrest parties making porn, as the statutes allow for that in NC. However, they likely will never do that (although if a big porn studio moved into NC, I'd bet my ass they would hassle them relentlessly). The biggest reason they wouldn't arrest a small timer is because the Federal Appeals Courts would find for the defendant on a first amendment basis (provided you met the standard, and they would dig into the facts to determine if you were really making art), which would immediately invalidate the statutes that NC has on its books.

    If they did charge you though, a defendant would have to pay a mountain of cash for his defense to make it to that point in 3+ years. It might be an effective strategy, however doing it in the open would directly break your cover. My guess is that an HSI team would still attempt to shame you by busting you and releasing your booking photo / information and then dropping the charges after it's been published (they love this tactic).

    It's an interesting legal thought experiment though, and if your life circumstances aligned to offset the risks to your reputation, it could be interesting.

    It's the Victim Impact Funds limit for this offense (per offense). When they are being convinced to flip (all these teams have counselors trained to sell them on taking this option), they are told they get $12 k.     If you were busted for soliciting before, even 30 years ago and paid the traffic ticket type penalty, you have a first offense already. Most criminal attorneys would just have urged you to pay the small fine in the past and move on, as it was a light misdemeanor.

    This means if you're caught under the new law, you are facing 39 months in prison for a second offense. A guy who DM'd me thought there was some kind of statute of limitations on prior convictions. There is not. If you've been busted before, DO NOT take the risk in NC. There are other places better suited to your situation. Save up and travel.
