A Michigan sovereign citizen who challenged jurisdiction of the Detroit city court and previously argued that he was only subject to common law or admiralty law was held in contempt and sentenced to a jail term under the criminal contempt law of Michigan. However, the judge failed to get on the record a knowing and intelligent waiver of counsel prior to the contempt proceeding. Thus, this would be in violation of the Sixth Amendment and Henkel v. Bradshaw 438 F2 d 1386. The defendant nonetheless failed to lodge a timely notice of appeal and therefore the judgment of contempt and sentence became final and non appealable despite the lack of counsel. The defendant subsequent to the contempt sentence then filed a federal 42 USC 1983 action against the judge alleging violation of the right to counsel. However, federal abstention doctrine applies under Younger v. Harris 401 US 37 since there was an adequate procedural state remedy which was not utilized due to defendant's error, that there was also a state court direct criminal contempt prosecuted by the judge, and the judge is protected by judicial immunity. Clearly, defendant may have a viable claim to vacate his sentence under Rule 32 due to himself providing no adequate assistance in his defense.

Since the last court hearing the defendant now accepts the appointment of counsel on behalf the defendant with the defendant making special appearance and requesting the jail sentence be vacated. The judge declined to vacate same and set pretrial conference for September 2023.
