So a couple of weeks ago, I did just that. I ran a search on any appellate case in the history of Georgia wherein the "massagee" was arrested and there were NONE. Further, I did a google search for any using "man arrested at massage parlor," and found NONE; at least for being the "massagee" or if you like, the "masturbatee".

Remember, the statute says it must be for "money or the substantial equivalent thereof. " The court said the agreement was for a "tip" meaning "money," and so she lost her appeal. So, if the masseuse says nothing and just provides the service (ostensibly, for gratis) with no mention of a "tip" or money, there can be no crime. Of course, the massagee leaves the appropriate amount of money and no one is the wiser and no crime committed. What says the lawyers here?

You could also try your walking tall, standing proud, routine at the local popo department, just to give 'em a heads up about your "illegal" intentions at the AMP spa you will be visiting.

This brings up (at least for lawyers) and interesting question: Just how does a customer get arrested at an AMP? Assuming for the sake of argument (arguendo, for you legal types) that masturbation is the crime, let's look at the statute:

OCGA 16-6-16: Masturbation for Hire.

(a) A person, including a masseur or masseuse, commits the offense of masturbation for hire when he erotically stimulates the genital organs of another, whether resulting in orgasm or not, by manual or other bodily contact exclusive of sexual intercourse or by instrumental manipulation for money or the substantial equivalent thereof.

(b) A person committing the offense of masturbation for hire shall be guilty of a misdemeanor.

Because criminal statutes are strictly construed, they being in derogation of the common law, (evidently, masturbation for hire has been a problem for a long time!) there is NO provision that allows the "massagee" to violate this law, it being limited to (in our case) "a masseur or masseuse". In fact, being the "massagee" is NOT a crime, according to this statute, even if the dastardly cops crashed through the door and caught the participants, in flagrante delicto. Of course, if they crashed through the door, that would be a violation of constitutional proportions, (First and Fourth) and the case would be dismissed on said grounds, and the cop most likely be sued by attorneys like me. (Now, that would be a fun case). So, accordingly, the only person who goes to jail is the masseuse. Ostensibly, (although I don't recommend) you could tell the cop in that case, "Yeah, she was giving me the business," and there's nothing he could do under this statute. I could be missing something, of course, and would like to hear from other attorney's on the list, but I will leave you with this:

Wait, camps do FS if you invest enough! This whole time I stuck with kamps because I thought only they did FS.

I think the key word here is "enough". How much is "enough"? Maybe some of us would spend a fortune trying to get a Camp girl to give it all up one time when they could have spent the money at a Kamp and gotten it all many times over but most of us would not be that obsessive, fortunately. It would be like taking a woman to dinner and a movie twenty times before she finally gives in, if she ever does. Not worth the time, money, or effort, imo. But, I also know that some of us live for the chase so to you I say release the hounds and chase that car!
