I am not a lawyer either but from what I have witnessed first hand or seen on COPS, yes I said that. If you give a false name or act rude you are "hindering" an investigation. I have always kept my mouth SHUT. Never say anything that digs a hole. I have always been told to leave the area and not come back. Guess what, I never play around with never coming back. I have only had to leave a girl behind once, she was dirty. That is why I appreciate CLS and NiteTimer for their info. Let me give then their props! Keeps me off the streets. If you don't have an ID they can write you up as a vagrant.

If you hang around the area and ask questions, but never close the deal with the woman, you could be written up as loitering. Those MTA cops make their living from seatbelt and speeding tickets. If they get "lucky" a drug bust. If that was a Balto city LEO, I might suspect he was trying to get a free one from the SW. Yes they need probable cause to stop you and picking up a kp (known prostitute) is not enough for probable cause and it is not even illegal in and of itself until talking about money for sex. Unfortunately, if you are arguing that the cop lacked probable cause, that means that you were arrested or issued a citation and now you are seeking to have a judge exclude evidence at trial. If you are arrested for something, they can then conduct a search incident to the arrest. I would rather say as little as possible when pulled over and take my chances cooperating to try to avoid arrest and save the probable cause arguments for court if necessary.

I was even stopped while on foot back to my car after engaging in the "hobby" with a SW. Generally, LE will tell you what you did (why the stopped you), and then ask you some follow up questions to ascertain whether you have a legit non-illegal reason to be in the area.

If you get stopped with a SW, 9 times out of 10 the LE knows that she is a SW. When you give your I'd, you give your address. As such, why would someone that lives 30 minutes away, be with a known SW junkie in his car? That is what everyone stopped by LE with a SW is up against the second they get pulled over. LE may do stupid things, but they are not stupid. What happens next depends on the officer: (1) some officers legitimately do not want to get guys caught up in the system for chasing tail, unless they are blatant / causing a disruption / doing something stupid or there is a specific sting going on; (2) some officers want to lock as many people up as possible, and view the hobbyist in the same way they view a drug dealer - As feeding the habit of a junkie and contributing to a situation causing / enabling junkies. The officers that fall into category (1), are the ones that will either give you a warning, give you a citation, and accept any reason you give for being in the area (regardless of how stupid it may be) and tell you to leave the area or that "you don't need to be here" / "I know what you are doing here. " The officers that fall into category (2) are the ones that search for drugs, harass you, and try to make your experience with them a catalyst to get you out of the hobby.

If an officer wants to get you, lying to him will only expedite the process, particularly if you are relying on a SW junkie to corroborate your story. The more you say, the more chances you have to make a mistake. If you say nothing, you have no chances to make a mistake and incriminate yourself.
