I'm not a lawyer, but I figure a DA would throw it out if it can be proved that a cop engaged in sexual activity of any sort. And the cop would lose his job. So, he'd have to lie and say he did nothing, and make up something. I suppose in that situation it could help to save the scumbag's scumbag. Then have your attorney say it's on ice and can be used to identify the cop did engage in something.
