Just out of curiousity, how many times have you successfully sued for damages and collected damages of any significance? Significance being defined as in excess of the cost of litigation. Collection being actually receiving the money damages in hand.

A little over $10,000 collected from two well known websites who settled out of court when they received a letter from my attorney after ignoring my DMCA Notification of Infringement. I suspect both of those websites in question have since modified their email filters so that anything containing DMCA in it will immediately be brought to someones attention. I now get responses and action from them in under 15 minutes of receiving my emails.

Collecting from legitimate websites who ignore a DMCA notification is easy, it's going after the girls who initially violated my copyright that's difficult, and rarely worth the effort. But I can at least keep them from using my images to misrepresent themselves and profit from them by getting the websites to take them down. My feelings on "airbrushing" are that it's acceptable so long as it's about equal to what can be accomplished with good quality makeup. That's what I do in photo shoots anyway. Otherwise I'd have to be rescheduling all the time just because a girl happened to have a pimple or two on the day of the shoot. Then there's also concealing tattoos to preserve the girl's anonymity if so desired. Good escorts will mention if they have tattoos airbrushed in their pics, but that part isn't my responsibility, and it's beyond my control. Now more "creative" forms of digital manipulation (eg breast enlargements, waist slimming, etc) I'm opposed to, and in my opinion is just as bad as using fake pics.

As for using "representative" pics. So long as they tell you that's the case, and aren't trying to say they're really them, I suppose it's ok. But I can pretty much guarantee that they're violating someones copyright in using the images. I know I've had my images stolen before, and I'm very quick to initiate legal action when I find out. Statutory damages for copyright infringement can be $750 to $30,000 per image in a pre-trial agreement, or up to $150,000 per image if it goes to trial. I can also file suit against any websites which post the images on behalf of anyone if they ignore my DMCA Infringement Notification.

But I can pretty much guarantee that they're violating someones copyright in using the images. I know I've had my images stolen before, and I'm very quick to initiate legal action when I find out. Statutory damages for copyright infringement can be $750 to $30,000 per image in a pre-trial agreement, or up to $150,000 per image if it goes to trial. I can also file suit against any websites which post the images on behalf of anyone if they ignore my DMCA Infringement Notification.
