Stet is 3 years but the brochure that I mentioned in my earlier post also says that "you may also petition the court for expungement at any time on a showing of good cause." So depending on your situation. Say for example you are trying to find a job, etc, then maybe you might get lucky and convince a judge to expunge the records on good cause shown. Otherwise, you have to wait 3 years.

Talked to Crystal about it too. She told me you can't ever get if off once they have it on file. I think she was just feeling sorry for herself. She was telling me how she used to work in dispatch making $25 dollars an hour 10 hours a day at one tine in her life. She's a Very nice girl but I wanted another opinion. My disposition is STET so I guess I have to wait a while longer.

Feel free to pm me on this issue if you have any questions. You can probably handle an expungement on your own. There is a good brochure available on the maryland judiciary web site on this issue. Assuming that your case was nol prossed (what is officially referred to as nolle prosequi in the brochure) , you have to either (1) wait three years from when the case was disposed of (which would be November 2013 based on your posting) or (2) you can do it now but you have to sign a release that is contained in the expungement form in which you release any claims that you may have against the police department, etc. The idea with number 2 is that big brother government does not want you to have your records expunged and then you file a lawsuit within the three year statute of limitations and they cannot defend the case properly because they do not have the records. So if you do not plan on suing the police department for false arrest, etc, then you are probably ok signing the waiver and seeking the expungement now. But if you are planning on pursuing a claim (or are not sure if you are going to) , then you should wait the three years. Expungements are automatically granted, assuming that you meet the criteria for eligibility.

I also refuse to pick up in that situation. I have seen this several times while cruising w / w in the last couple of months, with probably 3-4 different guys / girls, so it is not an isolated situation. But I only see this in the w / w area for some reason and there have been times when I have cruised by a couple of times and each time the dude was standing right there with her. Whether it be in the same spot or sometimes walking in the area. I do not pick up in that situation because I do not negotiate with sausage and sometimes it is hard to tell civilians apart from SW's, so I figure that it is sometimes possible that the guy is actually a boyfriend and not a pimp, and I do not need some dude pissed at me for trying to pick up his chick.

I was cruising Wilkins and spied a cute little SW on the corner of Wilkins and Millington in front of the church. She eyeballed me as I drove by so I looped around the block and stopped for her. Also, you are going to have to fill out a waiver (agreeing not to sue state, police, or officer) if the Nolle Prosequi was entered within 3 years, or wait 3 years (statute of limitations). The clerk's office should give you a packet with all of the forms that you need, and you will be waisting your $ if you hire a lawyer. Also, just FYI, the clerk's office cannot refuse to accept anything for filing (as long as its in proper form [signed, your phone number, address, and certificate of service, etc. ] and you paid the fee) , and the clerk's office cannot adjudicate the merits of a petition for writ of expungement. If they give you a hard time at the clerk's office, ask to speak to a supervisor.

Posts: 254If the disposition is Nolle Prosequi you don't have to wait any time at all, so long as you have no other charges pending. If the disposition was Stet, you have to wait three years. You don't need a lawyer to get it expunged. It's a simple form and costs $30 to file.

A couple of years ago I got popped by an under cover on wilkins. I should have known better by looking at her because her teeth were too nice. I took it to court with out a lawyer because at the time I didn't have the money for one. The public defender told me he could get it non processed and it would not show up on any background check. He lied! . I searched my name and found it. I was told I can petition the court in three years to have it removed. This all happened November of 2010. I called the court house and the lady on the phone told me if I didn't have any other cases on file that I could have it removed but ounce I got to the court office and filled out the forms the clerk said they would not do it. Can anyone give me advise on lawyer cost to have it expunged.
