Anything a defendant says can and will be used against him but anything the government says does not apply.

It could be that the crimes charged did not include the time period of the memo from the government regarding good conduct. Thus after the defendant assisted the government a crime allegedly occurred and this could be unduly prejudicial to the jury which is why it was excluded as evidence.
