From what I have read it is always somewhat contagious. There is no way of knowing if a person is a threat or not. In fact most people that have herpes are blissfully ignorant of that fact. What makes you think that they haven't? Herpes is highly transmissible when one has an outbreak of sores. That does not happen all that often. But no sores does not mean "safe". And there is no way to know if you ever had (which means that you would still have) herpes unless one goes to a doctor and have them do an antibody test. If you regularly go raw you probably acquired it at some time. About half of the people that have herpes are unaware of it. And unless you plan on having kids there is no need to know if you are positive or not.
