It's actually the same in all 50 states, once a person has invoked the right to counsel, LE is to cease all questioning. In the situation being discussed currently, when LE reaches out to a person and that person responds by saying they have an attorney, LE should then initiate any further contact through the attorney. That said, LE doesn't always do what they should (whether intentionally or otherwise), meaning they might try to contact the person directly without involving the attorney. In that situation, the person should remind LE of the attorney and tell them to call the attorney. Likewise, the person might contact the attorney themselves and ask the attorney to contact LE for them.

Not to feed into the hysteria, I did not get pulled over, I just got back to Kissimmee 2 days ago and went there today. Pulling out about 10 am a black truck with state yellow tags followed me for almost 10 miles. I made some odd turns to see if he was really following me, he was. I didn't get pulled over and eventually he split off in another direction. Was a little odd.

The letter is vague, it is only one paragraph and lists the exact time of the traffic stop as well as the date. No one needs to worry, I'm not going to talk to the police. If I am forced it will be with a lawyer.

I am not sure how the laws work in Florida. But in Wisconsin, if you get an attorney, and communicate that to the police, It is illegal for them to contact you about this issue and they can only contact you through your attorney. That will insulate your family from the issue.

Why is everyone hyperventilating about a letter from the state? The answer is simple. Get an attorney. Actually, all you really need is a few minute consultation with him. Then contact The vice cop back and tell him that all future correspondence needs to be handled through your attorney. Makes it illegal for them to contact you, other than coming out to arrest you. My bet is you will never hear from them again.

Posts: 294If you did get a legit letter and they have not arrested you then they do not have enough evidence against you. Talking to the cops without a lawyer could be a big mistake in my opinion. Personally I wouldn't do a dam thing about this I think it's just a scare tactic to get people to roll over on the AMPs.

Why don't you check out their sister spa in south Fl and ask why the police came in force, look at the Lauderdale site. Why did they close? Yup. Exactly. If these letters were real then I would have one in my mailbox for as many times as I have been to KMS in the last 6 months. Osceola's finest would have seen me multiple times and I would have told them the same thing I always tell any popo "Are you charging me? No then have a nice day" and then keep my mouth shout. It usually pisses them off something fierce but it is your right. My traffic lawyer does the rest.
