I agree with your conclusion that skipping discussion of tips is the best route for all involved. Note that based on this arrest, rubbing ones finger's together to "sign" payment or holding fingers up for an amount is still an expression that is considered as binding as spoken terms.

The providers should never discuss or even motion a HJ when discussing money or tips. If they all did that then there wouldn't be any busts and they'd get a lot more repeat customers. We all pretty much hate the hagglers and upsellers. But greed and stupidity usually takeover.

I stopped in one day last week for a visit. I had not been there in a very long time 3-4 years. I called to make an appointment as I was in area and said I would be there in 10-15 minutes. I was 10 minutes late as I had a phone call last longer than anticipated. I called back and she was about to leave but came back. I was greeted discretely at back area and let to office. A Massachusetts masseuse whose customer was a law enforcement officer was charged with 'sexual conduct' for a fee after she did a gesture indicating she was offering to do a hand job for a fee. Using a gesture rather than quotable words did not protect her from being arrested and charged with a violation.
Only a month and a half before in my report on 10-29-2012, Report #207, in the Forum / Special Interests / Massages thread I'd written this about the Massachusetts law:

Obviously, the arresting officer had a broader definition of 'sexual conduct' in mind than the lawyer whose web cite I quoted in the above report. Since the Massachusetts statute does not define what is meant by 'sexual conduct', and the lawyer's web site defines the term in a way that does not include what the masseuse offered to do, I think she has a valid defense.
Nevertheless, forewarned is forearmed.
What Massachusetts masseuses need to do is go ahead with a hand job if the customer seems aroused but NOT ask for a separate fee for the hand job. In other words, forget the 'upselling' and hope the customer will tip generously. Asking for a separate fee for anything sexual, even a hand job, is asking for trouble. A customer accepting such an explicit offer is also asking for trouble although in my opinion if it winds up in court he also has a valid defense.

Drove down HandCock Street in S. Braintree and stopped in. Was there a few years ago and had a lousy experience with a very old chick. But since I was driving by I stopped in to scope it out to see if the place was even there still, it was. Much different chick this time. Alot younger, called herself Angel. Pretty goog massage, good tease and good ending. .5 for 1/2 hr, .4 tip. No signage on door or pretty much anywhere so they keep a low profile. Thinking about going back but I don't know if I'll get the same chick. I saw a place on rt. 18 in South Wey. Across form the old Navy Base in a strip mall with restaurant, convenient store, and salon. I think it's pretty new. Anyone been there yet?

I posted this yesterday: Drove past Foot Massage place around 6:45 on other business. Lights were out. On the way back I detoured past the Comforts place on Copeland, about a mile away. Their lights (on second floor above hair salon) also out. Before closing time for both, so something must be up.
TODAY: Again on other business, drove past in the daylight and noticed that Foot Massage was back to displaying the OPEN sign. Maybe they were sitting there in the dark last night, and only taking appointments, going lo-vis on account of the much more crowded center of town that comes with a Friday night. Something tells me not, because the Copeland place did not re-open. Pulled the door. Locked. Hard to say what's going on in Mansfield, but of the two I'd have expected the more visible foot place to have a shorter lifespan, because of its sore-thumb location. Maybe they were both investigated, and only Copeland was judged to have been up to something unsavory? Or maybe the hair place next door to Copeland called in the air strike. I did check CL, and noted that both had posted ads every day through Dec 13, but neither has done so since. Hmmm.
