In fact it is usally after one has said something that would or did incriminate them, or their partner, as was the case here. So the best thing to do is say NOTHING, and ask if you are being detained, and if so, insist on speaking to your Atty.
The other element here is that since this fellow is an active duty Air Force Officer, and that this story is now made public via the newspaper, and there is certainly a paper trail via the legal system, that internal affairs military will certain gain more info on the subject. That additional info could and likely WILL end this officers military career. That is a big price to pay for being uninformed as to how to handle contact with LEO's.

Also, LE believed they had similar contact with Lt Col about a yr ago. Meaning they KNEW he was active duty Air Force. He took her to HER apt, not his home. They followed them or spotted his car outside, waited and in 15 mins he supplied them ALL the info LE needed to convict the SW and himself. Of course he will likely not be convicted but this incident will likely END his career due to the publicity of it, which is considerably worse than him being arrested IMO.
LE is interested in splashing publicity all over the paper and they certainly achieved that in this case. But the Lt Col made this way too easy on LE; had he klept is freakin mouth shut, known what to say and what not to say, both of them would have left w / o incident. The proper thing for him to have said was,"Am I being detained? If so, I would like to speak with my Atty at the earliest possible opportunity. I have NO further statement to make until I speak to him / her". At that point the convo is OVER with LE, once those words are uttered. It is called "Pleading the Fifth", and we have all heard of that before. Everyone who walks a bit outside the lines once in a while, (to para phrase Lawrence Taylor in his recent soliciting a prostitute publicity) , should be familiar with their rights under the 5the amendment and your rights of no self incrimination. Pretty elementary stuff really, but appreantly the Lt Col didn't know or chose to waive his Fifth Amendment rights by talking to LE.
