Yes that's true, but the cops have to prove this first. This is why you should remain silent. So bottom line is that the cops can't arrest you for merely being with a minor. Let me reiterate that I don't believe in dating minors.

Yes. Always remain silent. Police are trained to take your statements and make them fit with their suspicion of a crime. People make the mistake of trying to explain a "reasonable" excuse, to get out of "trouble". Last thing you want to do. When cops are trained to think beyond a reason for people committing a crime!
The penalties for a pimp, are severe under both federal and Nevada statute for prostituting someone. You'd probably get less time for kidnapping an adult women and putting her to work. The girl most times will not have id and will not give police her real info. Most girls have arrest alias. Cops cant prove otherwise. Saying nothing is your best bet for going on your way.
Well I drove all around tonight and didn't see much all night so I went home and fell asleep around 3am. I had a great dream, I was driving down koval and headed toward the hard rock and saw sally walking in the cold so I gave her a ride. She is a 23 yr old blonde from wisconsin. She asked me to buy her a beer and cigs so we headed to the store. This store was right across from the red room, a swingers club, and she asked if I wanted to go in there! I told her next time we can go in there. We drove to a safe place and had a ok time. I got the feeling she doesn't like giving BJ's so we settled on half and half. She gave a lack luster cbj and then pulled her pants down to her ankles and lifted her feet to the roof. This was a great position because it made her tighter. She was into it and we both had a great time.
After we got done I took her to her place which was right there and got her number for next time. Her beer and cigs cost me. 60 and it was worth it. I just wanted to share this dream with you guys.
reconcile the 2 statutes, poncho.
the one you posted, nrs 201.195, deals with minors and a cutoff age of 14 and deals with the “infamous crime against nature” in a homosexual manner only. see the definition-- as used in this section, the “infamous crime against nature” means anal intercourse, cunnilingus or fellatio between natural persons of the same sex. (caps added)
for a statutory sexual seduction, commonly known as statutory rape, you must look at the statute i posted-- nrs 200.364. that makes the age 16 the cutoff, provided you are over 18, which most of the visitors here are.
3. “statutory sexual seduction” means:
(a) ordinary sexual intercourse, anal intercourse, cunnilingus or fellatio committed by a person 18 years of age or older with a person under the age of 16 years; or
(b) any other sexual penetration committed by a person 18 years of age or older with a person under the age of 16 years with the intent of arousing, appealing to, or gratifying the lust or passions or sexual desires of either of the persons.
note- section (b) refers to toys and other objects.
the statute you referred to is basically irrelevant to this discussion-- unless you're homosexual and picking up boys. that is when it applies-- by its own definition. no offense intended, just emphasis for clarity.
the statute i referred to applies, by definition, --to including sexual intercourse in its ordinary meaning. (caps added) this would be your garden variety hetrosexual penile/vaginal relations.
that statute also only prohibits contact under the age 16. there is no prohibition under the age 18 in this statute. this makes the age of consent for sex- 16, not specifically prostitution.
prostitution is a different animal-- sex in exchange for anything of value. another element, another fact, another statute.
so we need to look at the prostitution statute and definitions therein.
nrs 201.295 definitions. as used in nrs 201.295 to 201.440, inclusive, unless the context otherwise requires:
1. “adult” means a person 18 years of age or older.
2. “child” means a person less than 18 years of age.
3. “prostitute” means a male or female person who for a fee engages in sexual intercourse, oral-genital contact or any touching of the sexual organs or other intimate parts of a person for the purpose of arousing or gratifying the sexual desire of either person.
4. “prostitution” means engaging in sexual conduct for a fee.
5. “sexual conduct” means any of the acts enumerated in subsection 3.
once defined-- child- person under 18, it is necessary to see where that word is used. and these definitions only apply to the enumerated statutes.
it is not in the basic prostitution statute.
nrs 201.354 engaging in prostitution or solicitation for prostitution: penalty; exception.
1. it is unlawful for any person to engage in prostitution or solicitation therefor, except in a licensed house of prostitution.
2. any person who violates subsection 1 is guilty of a misdemeanor.
(added to nrs by 1987, 2027; a 1991, 462)
however it is used as an enhancement factor with regard to the penalty in the pandering statutes.
basically, this analysis (worth what you paid for it and not legal advice, just general information, not licensed in nv) tells me that if you get caught with a 17 year old hooker, you looking at a basic misdemeanor solicitation charge, with no enhancement for the age. i really do not believe the pandering statutes would apply to your basic monger.
be that as it may-- stay away from anyone looking remotely ****.
but also look at:
nrs 201.190 commission of certain sexual acts in public: definition; penalty. except as otherwise provided in nrs 200.366 and 201.230, a person of full age who commits anal intercourse, cunnilingus or fellatio in public is guilty of a category d felony and shall be punished as provided in nrs 193.130.

Your statement of picking up and transporting knowingly to get the minor under 18 to prostitute. Well even if your the customer, could be easy to argue why for conviction you do not meet the customer definition.
I do agree with Nemo, fact is lots of 18 year olds get put in jail for carrying on relationships with their 17 year old girlfriend. Against the parents wishes, the true source in most cases of a minor under 18's actual consent for sex. With prostitution, in most states it becomes the government decision for the minor.
If they as in police, to prosecutor decide your statements back up charging you. Your screwed even with a good lawyer! I like my job, so do not want the added risk of getting more than a simple misdemeanor. Also travel, like going home to Canada, and having a hassle free return to the USA.
Any you guys see two girls on Decatr and Flamingo, after seeing them get dropped off I busted a u turn and wanted to pick them up. So after driving around I see them and I pull over, them they get in a another car so I was like duck it I'll follow them, I end up driving north on decatr to 95 then to Kyle cayon. Then I was fuck it I turned around. I spent the whole time think WTF am I doing or what the fuck is going on?
If I'm not mistaken, the age of consent is 16 not 18 in Nevada. I don't know if it's changed within the past few years but I know for fact that when I moved here in 03 it was 16.

It is for regular relationships it is 16. I'll have to look, believe like most states. Close in age is a factor, some places are 3 years, others are 5 years older then the girls junior. So a 21 year old could do 16 year olds in WA for example. 22 however could be a problem. I know for sure, people who volunteer, teacher's, even university instructors, the legal age with position of authority, legal consent is 21.
Most states, believe Nevada is one (not 100%). Have a deal. You can have consent for sex, but if the parents find out and tell you stop seeing my daughter. If you continue, you can be screwed by other laws. It's the source of most appellate decisions on assuming the girl was older. Most states even with 18, realize 16 year old girls can and do sneak into bars. Reasonable people assume those in bars are legal being 21. So normally in most places they'll let that slide. I dated a 17 year old because she was taking college courses. Assumed she was an adult out of high school. Was 30 at the time. She came onto me. Even though WA is technically 16, and my assumption of her being older, at least 18. The second I found out she was in high school, ended the relationship. Women scorned, and or parents pressure can get older "seducer" even if it was her doing the seducing in hot water.
This is not really legal advice. I admit like Hefner, don't like girls over 24. I' am actually good looking, have game. Mid 30's, I have had girls on school buses give cute little flirtatious waves. Few months ago, was at a friends daughters wedding. The bride was a cheer leader coach, 23 years old. Most of her friends including high school cheer leaders, hit on me. One girl, was so obvious, the bride whispered: "watch it she's 16!" In short, I've dated non pro civilian normal girls 19/20 years old in the last couple of months.
Problem. We have nothing in common except for sexual attraction. Other then the bedroom, they are annoying to be around. I'm addicted to sex. Its more honest, to play with pros. Over stringing along, using some college student for sex. So I've also researched these laws. Well sometimes when some hot appearing 20 year old flirts with you at Starbucks, little head says from one of my teen years favorite films: sometimes you have to say What the f8ck!
disagree with poncho. first, the statute expressly excludes customers. proving you meet the other statute definitions takes more than argument, it takes supporting evidence. picking up a working girl, age 17, should be of no more concern from a legal standpoint than a 25 yr. old.
the morality aspects are different, stay away from anyone remotely **** looking.
viva vegas, you are correct about age 16. see the statute and explanation i posted a couple days ago for information.
poncho--as to the rest of your comments-good luck with that in the future.

Okay back to some reporting on the streets, I was in the main street, to okley to charlston area and there abou 4 women out. One I kept trying to get her attention a hispanic woman. Guess she didn't' need the money that bad.

This past weekend was just a straight out bust. I spent about 10 hours total cruising the streets. I saw MAYBE 3 or 4 I would have picked up, but they all got picked up by someone else first. First time ever I couldn't get a BJ.

thanks for getting us back on track again, and we will hopefully be able to read some useful reports. I am staying downtown in the Freemont area for a few days and hope to be able to report soon.
