Legalized vs decriminalized + fed govt interests
Full disclosure: I haven't read the text of the proposed Colorado legislation.
That being said, decriminalization generally just implies that the state would turn a blind eye to formerly criminal behavior that falls within certain limits. While I didn't closely follow (not being a partaker) the details of the various marijuana decriminalization and legalization efforts, IIRC it began with allowances for possession of a certain amount defined as personal use, while maintaining legal penalties for larger (non-personal use) amounts. Whether specific laws are repealed, changed, or simply not strictly enforced, the practical effect tends to be the same.
IMHO, the above model could serve as a template for decriminalizing prostitution. To follow the analogy, "personal use" would include consensual private sexual activity, with $ exchanged, between two adults. The state could specifically exclude anything that involved third parties, such as agencies, AMPs, more than one provider working together, and anything involving public places (like streetwalking). So visiting an independent provider at her incall, or at your outcall location (home or hotel), would fit the decriminalized personal use scenario.
Another point to consider is that decriminalization is probably easier for the state to manage than legalization. That's because legalization generally involves things like licensing and state-imposed requirements that will need to be monitored and overseen. Again, if I'm not mistaken, the marijuana efforts began with decriminalization and only afterwards did full legalization follow. Speaking strictly from the perspective of a private monger, I'd much prefer decriminalization because that would seem to require less government involvement.
With respect to the federal government, they usually don't involve themselves in misdemeanor activity, which is how private, one-to-one, prostitution is usually classified. They certainly would still be involved in anything they could classify as "trafficking," or anything that involved something serious like money laundering. Again, it seems like marijuana decriminalization has found a way to coexist with the Feds, so why not prostitution?
Can't speak to the situation in Nevada because I don't have those details. But NV legalized prostitution is brothel-based, which are licensed commercial businesses, and certainly different from the private consensual activity described above.
To be clear, I'm not saying I have any expectations about the Colorado proposal. I simply think it's worth watching. For those familiar with the concept of the Overton Window, policies that once were considered outside the realm of acceptability (like marijuana use, same-sex marriage, etc.) can eventually stay in the window long enough to become accepted. If the Colorado proposal garners serious discussion and debate, that helps keep it in the window even if it doesn't pass.
