Under the loitering law you can be cited for beckoning. You can also be convicted by "engaging or attempting to engage in conversation". This is unconstitutional unless the state can prove the communication was for prostitution. The other factor to remember is that this is a misdemeanor. Typically misdemeanors are handled by the city attorney. I you are arrested than the thing to do is to hire a aggressive lawyer. Have your attorney delay the case as long as possible. Then at the arraignment plead not guilty and ask for a jury trial. There is a very strong chance the the prosecutor will drop the case on the day of the trial or before. Prosecutors do not want to deal with jury trial over a minor misdemeanor. A public defender attorney told me about this. Normally patrol cops will not arrest you for loitering. The thing to remember however is that in sting operations vice cops are looking for anything they can to arrest guys. Thankfully in California they got rid of the obnoxious loitering law. CA's loitering law was a catch all law that essentially allowed the officer to use almost anything they wanted to be "loitering". So because of this it is very important for us to follow the 22 rules and drive a good distance when picking up SW's. So in the end it is important not get overly paranoid. But it is equally important to use caution and stick to the 22 rules.
