If I got married with the expectation of sexual fidelity on Saturday, and I'm already planning to be banging a hooker on Tuesday afternoon, that's fraud. I got something of value but never intended to fulfill the contract.
But if I got married, and things went stale: she's not happy I don't make as much money as her friend's husband; I'm not happy the sex dried up. So I start banging hookers somewhere down the road, that's more like civil breach of contract, and that's a morally different situation.
I think a better analogy is this:
I have a business, and you contract me to sell you widgets for five years at a certain price. Then I take your deposit, go bang hookers in Costa Rica and never supply the widgets, that's fraud. It's evil morally and criminal legally.
But say I do supply the widgets for three years. Then the Chinese supplier who makes the frobits I need to make the widgets raise their prices. My profit margin gets cut in half. Meanwhile, due to a tight economy, you are continually late paying your invoices, but not late enough to kick in penalties or dissolve the contract. So I just quit selling you the widgets and sell them to someone else for more money. That's a civil breach and has both different moral and legal connotations than fraud.
I have made quite a few women uncomfortable over the years when this kind of conversation comes up. I point out that sexual fidelity doesn't just mean you won't have sex with others. It means that you will also take on the responsibility for your partner's sexual fulfillment, and accommodate reasonable sexual requests. Now, nobody should ever be forced into sex, even by circumstance, but if you are married to someone you don't want to fuck, maybe YOU should be the one filing for divorce. But if you are going to hang around and be unfaithful by omission, you can expect your partner to eventually be unfaithful by commission.
It's easy to say, "that's fraud. " Until you have a wife that's disinterested in sex, two children in the house you love fiercely, and a business you built with your own blood, sweat and tears that she'll get half of—unless you want to mortgage the business to buy her out.
TLDR: Life is complicated, and only a Sith deals in absolutes, or something like that.
