rh your right about the commmerce. 16 or older is legal for sexual activity, but not for prostitution or pornography. but the "close in age exemption" does not apply to anyone over the age of consent (16 in nc) the law if for minors under the age of consent, so for example a 39 year old guy in nc can have sex with anyone over the age of consent (16) and not face any legal ramifications, but if the girl is 15 or younger the 19 year old is breaking the law, however, she can still have sex with an older guy over the age of consent, but only with one close to her age. the "close to age exemption" applies to minors under than age of consent (and in nc it is 3 years not 6)
this law is only in place because of parent trying to get their daughters older boyfriends arrested for statutory rape (like a parent of a 15 year old trying to arrest a 17-18 year old she goes to school with and is dating) but again remember guys even though she is legal to have sex with at age 16 she is not legal to pay her for sex (just some food for thought if you can get a 16 year old for free it's legal just don't pay for it. lol)
