But it's hard to imagine LEO will be using this proposed new law because if you aren't convicted the city will have to pay the impound expense and the vast majority of first time offenders never go to trial and are instead diverted to "John School" where the charges are dismissed after completion. The law will just be a hammer LEO will use to intimidate you if they stop you in a prostitution zone. But as Avenue can attest, they really can't do anything but waste your time.

This is basically the same law as in CA. It's really disgusting that the cops seize your car they impound it. Hopefully their is constitutional or other court challenge to this law. Any idea how actively the cops are using this law. My guess the cops are using law when they catch someone who has picked up a SW and stopped to do the act, but they don't have enough to arrest them.

I'm fairly certain that if you get sent to John School, it's because you plead guilty and asked for the deferred prosecution. Just because they have to drop the conviction after six months, doesn't mean they (the city) will have to pay the impound fee. You will pay it along with everything else. The only possible scenario where the city would have to pay the impound fee, is if you contest the case and beat it in court.

I not entirely certain because this is a civil not a criminal law. All that is needed is "A law enforcement officer has probable cause to believe that
22 the property was used or is intended to be used in violation ". The question is what constitutes probable cause. A interesting test case would be is if a cop sees you give a SW a ride and impounds your car. Is this probable cause constitutional or not. So you would have to challenge this law in civil court.

You're spot-on about that, Civ2000. If you get sent to john school, it has to follow conviction or the equivalent, as in a deferred prosecution. The entire forfeiture proceeding would be over long before you finish the six-month or year long deferral.

I'm surprised that Olympia is considering as primitive a bill as this one. Most states have adopted language to get around the five-year-old Supreme Court decision which allowed Illinois to seize a car even though it was owned jointly by the defendant's ex-wife.

As someone who has gone to John school I can tell you exactly what happens. They give you 2 options - go to court or go to John School. If you go to John school they will dismiss the case after completion of the program (1 day class) and a $500 fine. There is no conviction and you don't come within 100' of a judge or prosecutor. Whole process takes about 4 weeks. They don't prosecute if you don't get in trouble within 2 years (thus why it's called deferred prosecution).

For me although I fully believe I would have prevailed if I had gone to court (the SW fought it and got the charges dropped due to lack of evidence) it was just cheaper for me to pay $500 than pay for a lawyer. Now if they had impounded my car and then try and charge me an additional $500 I most likely would have fought it. Then when the city dropped the charges they would be liable for the impound charge themselves.

That is why I don't think this law will be used much if passed. The city has a vested interest in solicitation charges getting deferred prosecution. The more people who fight these the more it costs the city (both in prosecutors and in paying impound fees if they lose) and the city isn't interested in spending more money for low priority criminals no matter what laws the state passes.

But if you are worried about getting your car impounded you shouldn't be picking up hookers. Always the chance you're going to get caught.

I cruised the usual strolls after work this evening and found nothing, so I decided to try my luck further north on Aurora. Now, I just don't like Aurora and don't go up there very often. However, it is my belief that late afternoons/early evenings can have some good offerings, so away I went.

Landing near the KK stroll, I saw a few girls of color out strolling - some too heavy for me, others just about right. As I was mulling over my decision as to which one I was going to pick up, a nice-looking blonde girl in tight black stretchy pants made an impression on my radar, so into the parking lot I went to snare her. Took some doing as she was strolling back and forth between two parking lot entryways near the Krispy Kreme, but I sat and stared at her through my windshield as I sat in a parking space. Finally, over she came and jumped in.

I had scored a girl calling herself Molly, about 5' 6'', blondish red hair, nice light eyes, good teeth and probably C cups. She seemed pretty clean and she was definitely friendly. Molly and I went over our options and she suggested that we might be more comfortable in her room further up Aurora in Shoreline. I resisted because I don't like going back to a girl's room and she was totally fine with not going back. However, after circling and circling for a good spot and not finding one (it was about 7pm with lots of traffic still in the area), I told her i'd go back to the room and check it out but if I didn't like it we'd have to date elsewhere or I was backing out of the deal. Again she seemed totally okay with that.

We arrived at the motel and I noticed right away a very tall, thin bleached blonde with a very nice body hanging around the lobby of this motel. She had some serious curves which showed well in her tight form-fitting pink gym pants. I asked Molly who she was and she told me that her name is Lilly and that she's a dancer at Sugar's. Thinking nothing more of Lilly, I went inside and inspected Molly's small room.

Shower check - all clear.

Closet check - all clear.

Under bed check - all clear.

Both door locks firmly locked in place - check.

Window shut and locked - check.

The room was small and definitely feminine with no hint of a man so I set flaps and reported ready for take-off. Shortly thereafter, Molly wrapped her lips around my throttle and my head was in the clouds. She gave me a nice covered blow job followed by enthusiastic doggy style with her matching my rhythm in perfect time.

Afterward, I asked her again about her friend Lilly. Molly replied, "come down to her room with me and meet her!". A few seconds later, I was standing in Lilly's unkept room with her giant cat. She was very pretty (Lilly, not the cat) - probably about 28 or so, maybe 5' 9'', very thin 32-34'' waist, nice little A/B cups and generally the kind of slim curves that really make my engines go into full afterburner. Lilly aslo had a nice face and fairly good teeth.

Lilly was freaking out because rent was due and her "man" was drunk and walked off somewhere because he was also freaking out. I found her nice, but she said that she was too drunk to go dance her shift at Sugar's this evening and wasn't sure what to do. I asked her if she "worked" and she told me, "I used to be a high-priced escort but I decided to go back to stripping. I only "work" once in a very great while, and now just happens to be one of those very great whiles!".

I was ready to engage, but Lilly told me that she had some things to take care of and that she'd like to call me. I gave her my TracPhone number and am awaiting her promised midnight call, I'll let you all know how that turns out.

Anyone date or see Lilly at Sugar's before?

The point of my earlier post was to respond to a post that had asked, if the city offers a diversion program, sends you to john school, and dismisses the case, can you get your car back? The answer is obviously, no. Some people are under the illusion that when a case is dismissed, it vanishes like it never happened. Just ask yourself, if that were true, how would the prosecuting authority know whether a john had been through a diversion program before?

That being said, Washington does not presently have a seizure law that applies to the the cars of johns.

There is still a arrest record. Secondly DA has a record of the case as well.

That's what Titman just said. Thanks for repeating it for him though. And thirdly, anyone with a computer can log onto the Seattle Muncipal Court website and see you got busted for prostitution years after the fact, even if you got the charge dropped.

Another thing, have you ever noticed a lot of job applications ask: "Have you ever been arrested except for minor trafffic offenses?" The question doesn't read: "except where you had it expunged, beat it in court, or were offered a deferred prosecution." The correct answer is yes, and then it usually gives you a spot where you can offer an explanation. Say you are applying to Boeing (where they will find out), you have to say yes you were arrested for solicitation, and then add the details. Technically it wouldn't disqualify you for employment since you don't have a conviction record, but it certainly won't help. And omitting it would be grounds for termination.

I cruised Aurora from 50th to 145th for an hour. I saw one girl she was a light skinned black girl ion a blue dress, carrying 2 bags. I pulled over for her while it was raining and offered her a ride. She told me the police were watching her and was scared to get in.I said I'm simply offering you a ride out of the rain.She started then backed off again. I left and figured I could catch her on the next side street.
Oh by the way she was walking along the Cemetery when I first stopped.Anyway, I turned right a few blocks down and was following 2 other cars.They turned again on the same street I was going to try and do a quick pick.Both cars pulled over and started to wait.I parked for a minute and decided it might get ugly with all three of us trying to pick up so I left.
Any one of you pick her up? please share info if possible..

First of all, "seize" isn't as good a word to use as "tow". If you park in a no parking zone the city tows your car. You could consider it "seized" if you want but all they are doing is towing your car and charging you a fine to get it back. If it turns out the city incorrectly towed you will they have to reimburse you? Of course they will. That or get the pants sued off them.

This is no different. If the city tows your car pursuant to an arrest for which the charges are later dismissed it's very likely you would be able to get that money back in court - which is why the city is unlikely to use this law even if passed. The city doesn't like trying prostitution cases - they often lose and it costs them a lot of money for a non-violent offender.

Of course the city could take the approach that they are "arresting the car" and only need a preponderance of evidence and it doesn't matter if you were convicted or not...but with our current slate of supreme court justices that would be overturned rather quickly if someone chose to fight it. This isn't Texas. Personally I'm not worried - let them tow my car and I will pay to get it back. The likelihood of getting arrested is pretty minimal.

I had the arrest expunged after the required 2 years had passed. Which means any search of any city or county records will turn up nothing. Does a police officer still have the ability to find it? That I don't know, but I don't have to worry about an employer finding it.

If you are arrested it stays on your record for 7 years on court records. After this the records are destroyed. There is still a FBI record, but this not accessible to employers unless you are getting a security clearance.

A record of expungement will show up, but this disappears after 7 years as well.
