Amatuer porn is legal, but certain details must be covered. A contract should be signed by the participating parties, detailing the date, action and salary. Amatuer porn is considered under the protection of freedom of speech as being a form of artistic expression. Adding role playing will secure your defense in court. It does not automatically let you off from being booked and appearing in court. Legit porn stars have been arrested before, appeared in court, and charges dropped. Taking still pictures of amatuer porn is also protected. Finding a provider willing to let you film is the hard part.

What we commonly refer to as pornography is not, in itself, illegal in Hawaii. Only what the courts refer to as "obscenity" is illegal. While all obscenity (in the sexual context) is pornographic as well, not all pornography is obscene. I'm speaking in "general" terms here, using the commonly used terminology in the majority of legal jurisdiction in the U.S. Here in Hawaii, it gets a little confusing, however. Our legislature, in its infinite wisdom, when it wrote Hawaii's statutes dealing with the subject it defined "pornography" to mean what virtually everywhere else (including the U.S. Supreme Court) means by "obscenity." What everywhere else regards as pornography that isn't obscene and therefore legal, isn't even called pornography. It's not actually refered to in the Hawaii Revised Statutes. However, it's all a matter of labels. Once you get used the the terminology Hawaii uses, the definitions here are the same as pretty much everywhere else. Just remember when reading the HRS that "pornography" in Hawaii doesn't mean what we think of as mainstream porn, it means what the Supreme Court defined as "obscene."
Now, as for your clever scheme, I have no idea if it would work or not. If you solicited an actual SW, then you wouldn't have a problem in the first place. You couldn't be arrested unless LE witnessed you offering "consideration" for a sex act. If you had the misfortune to solicit an undercover decoy to make your film, all bets are off. My guess is you'd be arrested initially, but might be acquitted at trial, if it even went to trial. I wouldn't want to be the one to test that out though! I do know that porn, both professional and amateur, has been filmed here occasionally, and sold commercially. Whether the producers had any legal situations arise in the process, I don't know.

It's only bad publicity if you're ashamed to be known as a pornographer. Larry Flynt, Bob Guccione and to a lesser extent, Hugh Hefner, wouldn't care if word got out in the press that they were making pornos! They would only be worshiped more.

Wonder if there's ever been videotaping in a MP, whether consensual or not? I always wonder if we're on candid camera and do a quick scan of the room to see if there are any obvious or possible hidden cams.
Anyone ever ask a MT if they would be willing to be in photos or videos, and more importantly, did one ever agree? I guess you would have to have the MS agree to this also. I bet if you offered enough money to both, some might have their price and be willing to go for it.

What does a porn star charge for "services rendered" compared to a provider
Usually people in pornos get arrested for indecent acts, especially in public, more than the fact that they are having sex. You would be hard pressed to get arrested in your own place behind closed doors making movies of yourself having sex with someone else, even if paid.
Services Rendered usually refers to a, one time, payment by check.
This can be done with providers also, if prostitution were legal.
Employers use this method of pay when an immediate need is required and the long process of employment paperwork can be avoided. Also, an employer can revert to this during a short trial period of on and off employment or just a short period. This is treated as a purchase and is written off.
You accountants out there can elaborate in detail on this.
While I do not know if anyone has gotten providers to agree on video taping for an additional fee, I do not think you should worry about being video taped in the act at the AMP. As far as I know it is a felony to video tape anyone in a non-public area without their knowledge. Besides, the AMP does not want to have any evidence lying around about what goes on, even if p4p cannot be proven.
So don't worry!!!
And don't even think about trying to secretly tape your session. It is a very serious offense, although I doubt that MS would report you to the police.

I have photographed several providers over the years and videoed a few... ALL with their consent of course. It never hurts to ask once you establish a rapport with them...

You are absolutely correct. The times porn stars get arrested its for indecency or trespassing. Police can't monitor what you do in your own home or in a hotel room. TX.
