It is all written down.
KRS 529. 020 classifies prostitution as a Class B misdemeanor. Under no circumstances does it ever become anything but. There is a statute raising it to a class D felony is the prostitute knows she has HIV. But prostitution without any other aggravating factors is a Class B misdemeanor and nothing more. First arrest; second; third; etc.
KRS 529. 040 makes promoting prostitution (that would be us as well as Ivan) a Class A misdemeanor unless the promoting is tied to providing premises in which two or more prostitutes are active, then it becomes a felony.
KRS 529. 060 says no one can be convicted of prostitution based on the uncorroborated testimony of the patron and no one can be convicted of promoting based on the uncorroborated testimony of the hooker whose prostitution was promoted.
Finally, to be convicted, you first have to be arrested. KRS 431. 005 states that a peace officer may make an arrest when: " (the) Without a warrant when a misdemeanor, as defined in KRS 431. 060, has been committed in his or her presence". There are several attorney general opinions that a police officer cannot obtain a warrant for an arrest for a misdemeanor unless the act occurred in his presence. However, a private person in whose presence the act occurred could swear out the complaint causing a valid warrant to issue.

You can be arrested for the commission of a misdemeanor if you commit it in the presence of a peace officer or pursuant to a warrant. For a warrant to issue, either the cop, or a private person has to have had the act committed in his or her presence. But, if the private person who witnessed the act happens to be the chick you just banged, you cannot be convicted based solely on her testimony (and, likewise, you can't get her convicted based solely on your say so).
But, note that should your favorite turn on you a swear out a complaint, the cops could have her testimony and what you (or I) wrote here about your dream. Thus, her testimony would not be "uncorroborated". But, what you write here cannot form the basis for an arrest since you are writing in the past tense and the misdemeanor would not have taken place in the presence of the officer.

Visited the East Spa last week. Very nice table shower but virtually no massage at all. Kind of disappointing. Everything else was on the menu though.
