Last night I called in a order for some Chinese food and while waiting for it took a drive down 3rd. My understanding of Ohio law is that both are M3 - 3rd degree misdemeanors. An exception would be if the person arrested has had a prior HIV+ test, then there are felony charges. One thing to note in online prostitution stings in the Dayton area, the person arrested is typically given the additional charge of "possession of a criminal tool" for using a cell phone. This is a 1st degree misdemeanor and in my opinion a bogus charge to increase chances for plea deal. I am not an attorney so could be all wrong.
