Wow. This is a great post to hit 100 with.

I noticed Lexi's ad in the classifieds here, and decided to give her a try, even though she's rather new. In this case, new is good. VERY good.

The cop thinks he's got you, that's why you were arrested. The prosecutor reads the police report, and he thinks he's got enough to convict you, that's why you got charged. To beat the case at that point, you are looking at a jury trial unless the state blinks (bench trial would be a possibility, but you'd have to have some pretty good insight on the judge to want to trust that path.)

At trial, the jury would be instructed on the charge "The defendant did knowingly or intentionally pay, or offer to pay, or agree to pay, money or other property to another person on the understanding that the other person will engage in intercourse or deviate sexual conduct with the defendant." (or genital fondling). Evidence would be presented, and the court would instruct the jury that the State can prove their case by direct or circumstantial evidence. Jury deliberates and decides if the state proved their case. Circumstantial evidence can be things like the nature of the initial contact (like responding to an ad in a well known website under the "escort" category) , the production of money, meeting someone you never met before in a hotel room. .

If the jury convicts you, the judge would sentence you within 30 days, and might incarcerate you until sentencing as you have no more right to bond. You could appeal the jury decision to the court of appeals and expect a decision from that group in about 9 months time (well after you served your jail time, if any). But who knows, the court of appeals may buy your arguments and decide that there was not sufficient evidence to support the conviction. You are out about 10K, but maybe law students and lawyers can read about your case for years to come and you can be the poster boy for "the John that got away."

Most folks, facing the embarrassment of public charges of this nature, take the first plea and put it behind them fast.

Part of the problem here-and I think it's part of the reason there's so much uninformed paranoia-is the confusion of the letter of the law with its enforcement. You can't go 50 in a 40. You can't rob a bank. But while it's possible you could be convicted of the latter on the testimony of one witness, you can't even be arrested-legally-for the former on the word of ten eyewitnesses. Maybe by a small-town sheriff in a plot device on Matlock. Misdemeanor vs. Felony.

So. You go out to dinner with a legitimate BP advertiser, and good luck with that. You can say to her outright "Here's $500. I want to go to Singapore, visit the rugged coast of Italy, and take the complete tour de France" and not be arrested for anything, unless you're foolish enough to be overheard by a nearby policeman with nothing to do. But you will have broken the law. We are talking about police stings, not whether you and a companion are technically violating a statute when you're alone.

I think everybody is missing a fine point though; if the police are running a reverse sting, you are getting arrested just for showing up. It won't matter if it's "right" or not. They will still detain you, get your information, and may threaten publicly outing you instead. They have to justify what they do sometime. Ever hear how some police target traffic offenders at the end of the month to meet a "quota"? Don't know if that is true or not, but there is some logic to the simple fact that leo has to show they are worth keeping in the business like this. It does happen. Boil it down; your are screwed anyway if you get caught so be careful.

After being motivated by Big Mack's report, I decided to have my first dream about Kelly Courtney. Wow, the dream was so good! Anyone who truly "just shows up", having never violated any law, has been arrested illegally. Solicitation is a misdemeanor. The police have to witness the act (that doesn't mean they have to videotape you fucking for money). What I suspect is that in the cases where someone says "I was arrested for just showing up" he had already published his understanding that something of value would be exchanged for sex, or criminal deviate behavior, maybe without realizing it, and that "showing up" constitutes proof, for the prosecutor's office, of his intention to act on that understanding. I don't really know, because I've never heard a complete explanation of any of those claims. Whether courts routinely accept this as "proof", or whether it's something Uncle expects to get away with because 99. 99% are going to take the plea, I can't say. But "knocking on the door of a woman who advertises on BP" is not a crime. Intent to commit a misdemeanor is not a crime. Arresting wholesale anyone who shows up at a particular address would be a very risky practice; in most settings the city would wind up losing a big lawsuit at some point.

Not talking may be generally good advice, provided you don't mind spending a lot of time being detained, but it doesn't really apply here."What you admit to" might get you arrested for the Lindbergh kidnapping, but it's irrelevant in a misdemeanor case. The officer has to be willing to attest that he witnessed the violation. And he'll be believed.

At only a slight risk of hyperbole, no one in the modern history of the Republic has been convicted of sitting next to an escort. Or having sex with a provider. Question was about calling a BP AD. Unless they use a private / unlisted number, you could have gotten that number anywhere.
