One right everyone has is the right to remain silent when questioned by authorities. In fact asserting your right to remain silent cannot be used against you. When questioned by authorities people often get the urge to lie, deny, or even say no. Unfortunately anything you say can be used against you. For example if an officer asks if you were in a certain area to do an illegal crime and you say no, the prosecutor can use your no to show consciousness of guilt and that you knew what you were doing was wrong Against you in court. However if you merely said I assert my right to remain silent that can never be used against you. And don't worry you didn't talk then. If you end up in court later you'll still get your chance to tell your side of the story if its in your best interest. But too many people lose cases because the made statements or denials right away when questioned. The right to remain silet is an important right. Know and exercise it appropriately.

Anytime you are questioned by a authorities you have the right to be represented by a lawyer. This is an important right as the lawyer can remove the fear and passion from the situation and help you decide when and if to make a statement. Another reason to demand a lawyer is the authorities must stop questioning you until you've had time to consult a lawyer. If they continue questioning you and gather more information without affording you a chance to talk to a lawyer anything discovered violating your lawyer demand will be surprised and can't be used against you. To ensure you are afforded this right you must affirmatively assert it. "I request to see my lawyer now before continuing" or "I assert my right to an attorney" work. "I think I want my lawyer now" or "I should get a lawyer before we continue" are not unequivocal and do not preserve your right. So carefully unequivocally assert your right to an attorney and consult to make sure it is in your best interest to talk.

Often when authorities stop someone they will ask for consent to see a cellphone, go thru a car, go thru a house, your coat or pockets. If they ask for consent that means you have the right to say "no" It doesn't mean they won't get a warrant and go thru those things anyway but it does mean they have to follow the letter of the law and it may limit them in what they can look at. If authorities improperly execute a warrant or go beyond the scope of what they can look at all of that extra stuff will be superseded along with anything else derived from the improperly obtained information. When you consent, you essentially give up the right to make sure they follow all the warrant rules and are limited in where they look. Everything you consented to can be used against you. Often if you do not grant consent, authorities may tell you it will be quicker plus they will get a warrant anyway. This is allowed. However if you consent, you still waive your rights to make them do things properly by a warrant with the chance something could get supresses. We all have the right to consent but we all have the right to require a warrant as well.

Even though you may assert your right to remain silent, unequivocally assert your right to speak to a lawyer, or refuse to consent to a search without a warrant, it doesn't mean you should be rude or hostile to authorities doing their job. They protect us all. Call them sir / maam, follow their instructions and be polite. However it is polite to know and assert your rights as appropriate. If you end up in court you want your defense counsel to be able to ask the officer if you were cooperative and polite and for him to say "yes. " Just remember asserting your rights is stoll polite and cooperative and the fact that you did assert your rights cannot be used against you.

Unfortunately we've all seen someone chased down the street or being arrested on TV by a local news program. The individual usually either runs or answers questions poorly. These answers can be used against him or her by the prosecutor or at best embarrass the individual in the community. What's the best way to respond in that situation? First don't run. They already have you on film and will show you running. Makes you look guilty, ashamed, and is embarassing. Second you don't have to answer the questions that are asked. That can and will be used against you in court. Even a denial if there is other evidence can be used to your detriment and people in The community will not believe your denial anyway. Instead, stop and no matter what they ask simply respond, " there's been a big misunderstanding and I look forward to clearing it up in the appropriate forum. " If they push, respond "this is not the appropriate Forum but I look forward to clearing it up then. " If you're asked detailed questions don't deny or affirm. Just repeat "there's been a big misunderstanding and I look forward to clearing it up in the appropriate forum. " Say nothing else no matter what gets asked. It won't hurt you in court and you'll look better in the community and on tv.
