Only asking "What are you offering?" will likely get thrown out of court, but you'll have to fight it all the way to keep it off your record (at least the last I heard, there is no longer a way to wipe the charges for a first offense).
Asking something like "would you take X for why services" (or possibly even saying "that sounds good to me") is a different story.
