Sure it's not something you want them knowing, but if you're both consenting adults there's no evidence of a crime in pictures alone. What got this guy in so much trouble was that several of them were drugged when he recorded them. Once they were presented with the evidence, they said they didn't consent. He screwed up and drew attention to himself, which in turn led to LE looking at his phone and finding the incriminating evidence.
I too was curious if he was a member, but unless he logs in and says "hey guys, it's been nice knowing you" I doubt we'll find out for sure.

For national security it may pass muster but if it is for pictures / videos would that fall under the 5th amendment and self incrimination?

This is the point I was originally trying to make. Don't keep the images or pictures because these girls can flip on a dime and claim they never authorized any of the images or video.
