Records developed by the Massage Parlor can ONLY be retained as evidence in any legal action brought against anyone CHARGED WITH criminal actions. LE has no right to seize anything that isn't described in a search warrant. Anything seized in that warrant CANNOT be brought as evidence in any other criminal action without a similar warrant issued in that case. In other words, if LE happens to grab a video record of a assault when seizing evidence in a prostitution bust, they cannot use the video as evidence in the assault case. They have to build the assault case on other evidence. The first tape may narrow the search for the guilty party but it cannot see the light of day in a legal proceeding.

Similarly, if property (video, cash, phone records, etc.) are seized lawfully in the execution of a search warrant and no criminal charges are subsequently brought. That evident MUST be returned to the owner and cannot be held by LE. To allow so, would amount to unlawful seizure of property. And, while copies of such records may be retained by LE, they CANNOT be used as evidence of wrongdoing in any way.

Things are bit different if video records are the property of the government (for instance, a traffic camera capturing criminal activity). That video is the property of the government and can readily be shared between governmental agencies. In other words, don't do anything stupid at the airport, or the courthouse, or even the DMV.
