If you were dumb enough to say that and the cop is annoyed enough that he wants to deal with the paperwork of booking you, you just tell your attorney is "I never said that, the cop is lying" and there's no evidence of your intent.

Solicitation itself is a misdemeanor, but you didn't do that, so intent to solicit? That would have to be even significantly less serious, how is a judge is going to to take a misdemeanor case to trial where the case against the defendant is solely what a cop says you said? You could tell your attorney that's it's all just a misunderstanding you nervous and just trying to make a joke (because who would tell the police they were trying to break the law?) and the officer didn't get your humor and thought you were serious or you just tell your attorney you never said anything about soliciting that the cop was trying to get you to admit you were looking for prostitutes and you kept telling him no but he didn't believe you and is lying that you said anything about looking for prostitutes.

Like I said, NOT a good idea to tell a cop that, I was using it as extreme example of how a cop needs EVIDENCE of you doing something illegal to charge you with a crime and make it stick.

You driving down a street in a 'bad' neighborhood isn't evidence of illegal activity NOR of intent to do something illegal.

You don't have to prove in a court of law that you had a 'valid' reason for driving down the street, they have to prove that you had an illegal reason, but again. How are they going to prove that?

But can a cop wanting to hassle you bring you to the station and make things complicated for a short time? Of course, they can even shoot you repeatedly even if you don't threaten them (at least if you are black) so it's never a good idea to be rude or flip or sarcastic to a cop or give a cop attitude.

Cops stop you to see if you are doing anything wrong or they think you look suspicious. Don't give them anything to be suspicious about by telling them a rambling inconsistent story about why you are driving down the street, just comply with any orders they give you and answer the bare minimum of questions and ask why you were stopped and if you are free to go.

As for "will it hold up in court" if you are charged solely on a cop's testimony that you said you were going to do something? Don't be ridiculous, no way it result in a conviction. Unless it's something like you telling a cop you are are going to commit a mass shooting AND your car is full of weapons and ammo and you have a m ap of your target, charging you with 'intent' isn't going to stand. In this case, charging you with intent to commit a MISDEMAEANOR? Have you EVER heard of that happening? Busts are for solicitation, not "intent to solicit". It's IMPOSSIBLE to prove intent based purely on another person's testimoney, even if the other person is a cop. If you are stopped with a known streetwalker in your car it's a better case but still hard to prove because you could have just given someone a ride, they can't prove why you are giving the person a ride. So convicting you of "intent to solicit" based on a cop saying you told him you were looking for prostitutes? Coudln't possibly stand up in court.

But for the record in case anyone gets the wrong takeaway from this. NEVER TELL A COP YOU ARE GOING TO DO SOMETHING ILLEGAL.

And you can say cops screwed me, blah, blah, blah, but only your buddies will agree with you and when their wives, girlfriends tell them no more sex if they continue hanging out with you, they'll drop out of sight too.

IMHO, its a wildly dangerous game (and fun) but if you get caught in any sense, it becomes wildly expensive money-wise, family-wise etc.
