Basically the first 2 instances are (with some exceptions) misdemeanors and subsequent instances are 3rd degree felonies. From the statutes:
1. A misdemeanor of the second degree for a first violation, punishable as provided in s. 775.082 or s. 775.083.
2. A misdemeanor of the first degree for a second violation, punishable as provided in s. 775.082 or s. 775.083.
3. A felony of the third degree for a third or subsequent violation, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
The exceptions are explained in Chapter 796 and they include increased penalties for someone who is knowingly HIV+ and such. If you happen to notice someone charged under 796.08 they might be trouble, but you can't be certain until the case concludes and a decision is rendered.
