750.213 Malicious threats to extort money.

Sec. 213.

Malicious threats to extort money—Any person who shall, either orally or by a written or printed communication, maliciously threaten to accuse another of any crime or offense, or shall orally or by any written or printed communication maliciously threaten any injury to the person or property or mother, father, husband, wife or child of another with intent thereby to extort money or any pecuniary advantage whatever, or with intent to compel the person so threatened to do or refrain from doing any act against his will, shall be guilty of a felony, punishable by imprisonment in the state prison not more than 20 years or by a fine of not more than 10,000 dollars.

She is essentially betting her felony against your possible misdemeanor. Tell her to drop it or you're going to the police.

If you do decide to pay up, what would stop her from threatening to tell your wife again next week and asking for more ransom money? I have no idea what I'd do, but I certainly wouldn't pay her. Usually, I just call their bluff, and they've never followed through. However, you never know when one may be crazy enough to do so.

At the stage you're in with this, consider bluffing. "My wife is divorcing me, so it doesn't much matter whether you tell her. " "You can tell her if you want, but a certain biker friend of mine is unpredictable when he hears about shot like this. Don't believe me? I guess we'll just have to see what happens. " Does it all sound too far-fetched? All I can tell you is that when I've stood my ground or when I've bluffed, nothing has ever happened. I plant seeds of doubt, even if they are far-fetched. The funny thing is that I really do know some shady characters who like and respect me who would jump in and handle some things if I wanted.

I can't say whether bluffing will work for you. It's just something to consider.

If you pay her what's to stop her from demanding more $ in the future. If she pushes the issue tell her you'll take your chances with a POSSIBLE misdemeanor against her felony and see who comes out in worse shape.
