Also I never post that much, I don't have a actual pic of me as a profile pic & I follow a shit load of providers because many of them use their real number on FB and it will show you the profiles of the people you have in contacts. Actually the FB profile makes me want to see them even more because I like learning more about who & seeing who I'm actually going to see. Just don't say anything. The only way that a provider could accuse me of impregnating her, is if she dug the cum out of the cover. All of my little Terry's have brain damage from slamming their heads against that wall.

Don't take this as criticism, but this is the way it works. You can't get a garnishment unless a judgment has been entered against you. A judgment cannot be entered against you unless you have been named in a lawsuit and you have lost. An action for paternity can be made by the mother, the child, or the Department of Human Services. See TCA 36-2-305. The burden of proof is always on them. Whoever files the paternity suit will have to file a complaint in the proper court and have the defendant father personally served by a process server with a summons and a copy of the complaint. He then has 30 days to answer. When he answers, he can simply deny he is the father. Since either the Mother or the DHS has the burden of proof, if they do nothing else, they lose and the defendant father wins. Whoever filed the complaint can then request a blood test, genetic test, or DNA test, but they have to pay for it. The test is conducted according to TSA 24-7-112. The mother, defendant father and child are all tested at the claimants expense. If the test is negative, the defendant is not the father, the case is dismissed and the claimant is left with all court costs, including the costs of the DHA test. If the test is positive, the defendant father has bought the child and will pay all the court costs. At that point, a garnishment can issue. But not before. Now, if a defendant has been served with a paternity suit and does nothing but throw it in the trash, in 31 days a default judgment will be entered against him and he has bought the child. But no one should be that stupid.

I'm well aware that my anecdote is not the norm. Just trying to point out that it can be (and has been) simpler than going to court to begin garnishment. It's not legal and will probably be overturned as soon as your complaint goes before a judge, but cases like this aren't going away due to a technicality anyway. You're also responsible for costs already accrued if you are proven to be the father. So if you'd rather not have your name on a court docket, I'd recommend getting the test yourself either way. If you're not the father, you bought yourself peace of mind and an immediate dismissal of any hearings regarding you being the father in the future (hopefully just avoiding that altogether, though). If you are the father, then you've saved yourself court costs at least.

And, no, I'm not a lawyer, though I've now read the articles regarding paternity and paternal testing, I guess. So take my advice at whatever value you wish to assign.

You need a test from both the mother and the child to compare DNA. If she agrees to it then fine. If she doesn't then you need a court order. You can't force her otherwise.
