I think the city's would have no problem taking car's & Holding them in storage until after a conviction is secured vs auctioning them for the simple fact someone is arrested. They don't do it for DUI, Robbery, Etc. Where a vehicle is used. What is to prevent an officer from arresting someone in a car he would like for himself ? Wait for it to go to auction then buy it himself ? Sure a long shot but anything can happen. This law is simply wrong on it's face everyone is entitled to Due Process under the law.
Reminds me of Carpool Lanes, Everyone who drives & buys gas pays nearly .45 cents Per Gallon in Taxes the money is taken to put in Carpool lanes that people can drive in who have passengers, They paid no more in taxes then anyone else. Go figure.

No offense, but eminent domain has nothing to do with property seizures (technically, forefeitures). Among other things, eminent domain requires the government to provide "fair compensation" for the property it has condemned. Completely different area of the law than this.
Aht169 is right. California state courts have already said the cities can do this. It would only be the Federal courts that can say no now.
You might be interested in the Hollywood threads. On this issue, the word is that the forefeitures were costing LAPD so much that they stopped doing it, at least for now.

Ewclark77 is absolutely correct. Eminent domain costs the government millions if not billions when they require citizens to hand over property for the public good. Forfeitures on the other hand don't.
What I have a problem with is the fact that vehicles are being taken away just for being arrested for mongering. No trial, no conviction, no nothing-car is gone!. Let's face it, forfetures are nothing new. It has been around since the beginning of our country. However there has always been due process! in the mongering situation there is none! Unlike 99.999% of all forfeitures, including drugs, illegal alien smuggling, other VIOLENT crimes, the property is never lost until the guilty verdict has been rendered. No guilty verdict, the property is returned. This is not what is happening here.
The lesson here is that even if you offer a ride to someone and a cop "claims" you were mongering, even if you really were not, you loose your car. Is this right? This strikes to me of old Soviet tatics rather than actions of a free and pluralistic society.
I say it again, isn't time the ACLU work on this issue?

Cities took vehicles in prostitution cases

Police in El Cajon and National City have begun returning vehicles forfeited during prostitution-related arrests – for a price.
Empowered by ordinances passed last year in National City and El Cajon that have stirred controversy in those cities, officers have been taking ownership of vehicles from men caught allegedly soliciting prostitutes during sting operations.
Now the police are willing to deal. In National City, police will return the vehicle for a payment equal to 15 percent of its value.
El Cajon officials are making similar deals, but the price isn't set at a flat rate, City Attorney Morgan Foley said. The owners of nine of 12 vehicles seized during a recent sting reached deals with the city, which collected between $16,000 and $18,000.
"We negotiated prices based on a number of factors, like age and Blue Book value," Foley said.
Some, such as attorney Mark T. Clausen, say the tactics show that police are running a racket.
Clausen recently filed suit against El Cajon, Oakland, Sacramento and Stockton over seizure ordinances there.
"The citizenry is being hustled by the politicians and the police when they are told that the ordinances are going to help remove offenders' vehicles from the streets and thereby stem the tide of solicitation and drug purchases. In reality, the first day after the seizure, the offender can buy the car back through a settlement," he said.
"What the process does is sell justice, plain and simple."
National City Senior Assistant City Attorney Rudy Hradecky said the offers are lawful and fair.
National City police recently offered settlements after taking eight vehicles valued at $63,000 from eight men accused of soliciting sex from a female officer posing as a prostitute, Sgt. Dan Fabinski said. The vehicles were valued at $1,000 to $23,000.
Money from the sale of the vehicles is used to pay for towing, storage and other related costs. In National City, half of what's left over goes to the law enforcement agency involved in the seizure, and half goes into the city's nuisance abatement fund.
In El Cajon, half of what's left over goes to police and half goes to the City Attorney's Office.
"The whole process smells of money, and the city attorneys running the revolving door just don't seem to get it," Clausen said.
"It is no different than offering $20 to a cop not to give you a speeding ticket, or cutting a $1,000 check to the police retirement fund to get your DUI dismissed."
Police in other county jurisdictions say they are watching how things play out in National City and El Cajon before moving forward with similar laws. (end)
Damn cops have nothing better to do but to be focusing on this vice what real crimes are happening out there! I cruise ECB, National City and El Cajon City often for the sights and potentials but am really reluctant anymore to stop because of crap like this.
