Very Good Advice, shut your mouth until you have an attorney present. Don't be intimidated or bullshiited by any cop into answering anything until you have a attorney present. They will try every trick in the book to get you to answer (and further incriminate) yourself.
Additionally, while on the phone don't ever discuss a sexual act tied to monetary compensation when calling the person in the ad. If you verbally discuss and tie these two items together, you just committed the actual crime (which is recorded). Before you physically appear at the meeting place, you have committed a misdemeanor. Nothing is easier than for the cops than to sit back, eat a bag of doughnuts and have the perp deliver themselves to be stuffed and cuffed.

It seems that the Politzei are stretching the law as far as it can go especially when they know the person or persons involved have limited resources with which to defend themselves.
Example: A friend of mine spent 3 weeks in jail on a "loitering with intent to commit prostitution charge" in a nearby city. They arrested her while she waited for a cab outside a Hotel
They questioned her and she wouldn't "give up" the name of the friend she had just visited, so since she had a previous conviction they popped her on the above charge, technically she did not have to answer any PD questions but once she said she was there to see a friend and would not identify that friend, they had her. If she had politely identified herself and refused any other questioning until an Attorney was present she should have been fine but she made the "Classic" case of trying to make an excuse and explain herself to LE. Lets face it they have the gun and uniform and car with all the lights and are extremely intimidating to the average citizen,"They absolutely know that they are intimidating" and play on it to get the citizen to incriminate themselves. Bottom Line: You cannot talk yourself out of trouble with LE you can only talk yourself into trouble by talking to LE. They are not looking for ways to let you go, that is not their JOB! The conviction rate would drop considerably if people just kept their mouths shut.
I asked her why she didn't call me and she said she did not know "anyone with a land line" and even if she did she would have to memorize a lot of numbers. The jail phones can only call land lines, apparently.
Her bail was only $1000.
A good attorney would have blown this arrest out of the water, but that Attorney would have needed FRONT money.
So she pled "Guilty" and got "time served" as a sentence. I'm not saying she was not guilty of something but they could not prove that charge but they knew they wouldn't have to because they know she has limited means. (Money) and could not afford a real attorney.
So they got the cheap bust without having to "prove' anything.
Of course I wasn't there to here every word but what I do know I posted here and I know the girl well and I know she is a bit anxious at times when she gets excited and I believe everything she told me.
The only thing they could prove was that she was a woman waiting for a cab outside a hotel who had a previous prostitution conviction, and apparently that was enough.
This is some food for thought even if you KNOW the law. —VS

If she was arrested for loitering then she was observed at the same location more than once or she was asked to leave the hotel and she didn't. A $1k bond is $ to a bondsman, they all accept collect calls and the numbers are posted on top of the phones. She would have been out in 3 hours. If she didn't have the $ on her (really? Didn't she just come from fucking someone?) the bondsman would have asked for some phone numbers cell or landline, and called on her behalf to get someone down to the bondsman to post the $ that your friend should have had in her property.
As for the police questioning her. The minute you say you want an attorney, you are admitting you have something to hide. When you get pulled over for speeding and the cop asks why are you driving so fast? Do you ask for an attorney? If a cop stops you and asks "why are you here" you say what you are doing. Waiting for a cab, if he asks where are you coming from and you are in a downtown or touristy area you say I can't find my ride (girlfriend, boyfriend, cousin Jimmy Mike Susan whatever) I came to the hotel so the cab can find me easier, can you give me a ride home officer? That cop will turn around and leave you alone. The devil is in the details. Why ask for an attorney, you are not under arrest, you are not being detained. Make sure you always carry your I'd. It is illegal to be over the age of 18 and not carry I'd with you. That is the #1 reason girls get pinched. No I'd so they have to take you in to run your prints and verify who you are. And finally NEVER EVER plead guilty to anything. Take it to trial or plead no contest (nolo contendre) make sure you go to all of your court dates and eventually the prosecutor will drop the charge because his boss is on his ass to close cases!) , and if you cannot afford an attorney one will be appointed to you at no cost (actually you have to pay $25 to see if you qualify for a Public Pretender) they will tell you that as they are placing the cuffs on you because you asked for an attorney and now they have to provide one! In my post I said she told the police she was there to "see a friend" when they asked to talk to the friend she would not identify 'the friend' this aroused their suspicion, so they ran her history, it's 1:30 A. M. And she's waiting for a cab in front of the Hotel and she does not provide them with a verified reason for being there and she has several arrests for Prost. They now have probable cause to arrest her. She does not walk the streets and her busts have all been on outcalls, I told her to stop the outcalls but the money always wins. The cops have nothing to lose, if the prosecutor files no information (Drops charges) it does not affect the cops at all. False arrest in 99% of the cases is a myth.
Remember this is not Orlando, in the bigger cities cops step over drunks lying on the sidewalks. (NYC) I've personally seen it.) And as it goes down the ladder the rules change dramatically. What goes on in NYC courts would get a judge fired and disbarred here.
Most PD's have portable scanners in the patrol cars to take prints but if they have no I'd to work from it takes much longer and you are going in. If she had no previous record she would not have been arrested especially if she had acted indignant. But Prosecutors and Judges are not stupid, when someone has no visible means of support (No job) and has a previous record and it's 1:30 A. M. In front of a hotel. They connect the dots.
She has no family in town and is not close to the family she has, so without her phone she has no numbers to give a bondsman. Don't know how much cash she had but unless she had enough to bond herself out ($1000) in cash on her person she would not have access to her money until she was bonded out. Unless you have a relationship with a bondsman they will not bail out a person unless the bond is secured, which means someone in good standing in the community would have to guarantee the bond (someone with equity in a house for instance) I've had to do it twice for someone, once was a 50k bond and I had to give them a promissory note (which is a lien) on my house and it wasn't released until the case was closed. So Papi it's not so easy or cut and dried. Now if you have a working relationship with a bondsman and you've always showed up for court and they've never had to chase you then they are happy to take your money. In the smaller cities they won't roll out in the middle of the night to make a $100 bucks because after the bond the defendant has to go to the office and sign papers etc. Etc.
There is a big difference between a traffic stop and a criminal charge, generally the traffic stop is considered an offense, not a Misdemeanor or Felony and you are given the courtesy of an "appearance ticket" this of course presumes your not drunk or driving 132 miles an hour and that you don't mouth off to the cop etc.
There really is no comparison between a traffic stop and a criminal stop.
You will be detained while "they investigate" the trick is to not incriminate yourself during the time "they investigate" by running your mouth or making excuses, you shouldn't be rude or abrasive but there is a moment when you need to inquire if you are being arrested or not and politely inform the officer that if you're not, that you want to leave and see what happens.
I have been stopped in what could look to be a compromising situation because of where I was stopped and the second question I was asked after license and registration was is whether I had ever been arrested, that is a very intimidating question because it implies you are about to be and they know it scares people. Think how you would feel if asked this question and what would be going around in your head. Especially if your guilty of something even if it's something you intended to do but have not done yet, your scared shitless, aren't you?
My point in this is that when you are under pressure 90% of people give themselves up even cops and attorneys give themselves up and they intellectually know better but GUILT is a powerful thing.
If you get an Attorney one of the first thing he will ask is "Did you give a statement" then 'is there any media involved" then as he collects his fee you will here " you understand there are no GUARANTEES and NO REFUNDS" this is after he has told you what a super attorney he is and how GOOD your case is BUT he hasn't seen "the discovery" (Prosecutions evidence") and after he sees that he will advise you how to proceed.
Translation: You guilty sumbish I'll try to make you a good deal if you didn't hang yourself with a police statement other than that I can only make sure your rights aren't being violated.
Best advice is to stay away from the legal system and be a good boy or girl. —VS
I forgot to comment, in Florida since 2005 a nolo plea can be used against you in sentencing in future sentencing, it used to protect you from being sued in Civil court based a guilty plea (You would plead Nolo and not admit anything either way) on a conviction in criminal court. But now it's pretty much an ego protector, you might feel better not pleading guilty but the result is exactly the same as far as the law is concerned. Sorry.

Nolo Contendre means that you agree that the prosecution has enough evidence to convict you. Not that you are guilty. A civil suit has no bearing on a criminal case. Just ask OJ and Casey Anthony. As for sentencing guidelines the Supreme Court ruled nolo contendre or no contest MAY not WILL be used in sentencing. And that applies to Federal cases where you accrue "points" towards your sentence depending on convictions. And yes N / C is a conviction, you just are not admitting guilt. The purpose of N / C is that in the future you may (again may) have that conviction expunged because you were not found guilty. Not even close to being the same as a guilty plea where you give up any right because you must allocute your guilt in open court. As for the bondsman. 50k bond is alot different than a 1k bond. You must put up collateral to secure the 50k the bondsman is putting up for you. Most bondsman do not lose their 1k bond even if the defendant fails to show up to court so its a quick $100 and yes any bondsman worth his salt would gladly go to Johnny Polk pick up a hooker and in the process bail out the other 5 girls in there too! Yes there is a big difference between a traffic stop and a criminal stop, my point was to not make a simple issue of a cop asking a girl questions at 1:30a into a criminal matter by asking for an attorney. The cop knows exactly what she is doing. He is hoping she opens her mouth and gives him probable cause. A cop asking you were your are going or where you are coming from is not an investigation. You are not required to answer a cops questions. It is not against the law to refuse to answer a police officers questions. Remember YOU HAVE THE RIGHT TO REMAIN SILENT.
[QUOTE=VerySlowly; 1394425]I forgot to comment, in Florida since 2005 a nolo plea can be used against you in sentencing in future sentencing, it used to protect you from being sued in Civil court based a guilty plea (You would plead Nolo and not admit anything either way) on a conviction in criminal court. But now it's pretty much an ego protector, you might feel better not pleading guilty but the result is exactly the same as far as the law is concerned. Sorry.
