In a previous lifetime I was a criminal defense lawyer in STL, MO (I've long since left the profession, and my license isn't in good standing *anywhere* so don't ask for legal advice). In my experience, the Feds aren't going to bother with a Mann Act prosecution unless you're a target they're looking at in another context (organized crime, alleged terrorist, etc.), and the Mann Act prosecution is a quick and easy way of nailing you for a few years prison, or a charge they can add to a shotgun indictment (i.e., charging a whole lot of different, unrelated charges) to help induce you to plead out on the charges they [i]really[/i] want to nail you for.
An out-of-state provider advertising for business here isn't going to subject herself to a Mann Act prosecution, no more so than a provider could be charged with "promoting prostitution" in arranging business for herself. The Mann Act originally targeted "white slavers"--interstate pimps, in other words--though the Supreme Court expanded its scope to include mere interstate adulterers and fornicators (that construction has since been voided by Congress in an amendment to the Act). In its current form, it's still targeting those who profit from interstate commerce in sex, NOT individual providers.

I read what you wrote here and technically it may be true, but, realistically it's not probable. The Feds have a lot bigger issues to worry about than 1 independent provider crossing a state line. In my experience, the Feds aren't going to bother with a Mann Act prosecution unless you're a target they're looking at in another context (organized crime, alleged terrorist, etc.), and the Mann Act prosecution is a quick and easy way of nailing you for a few years prison, or a charge they can add to a shotgun indictment (i.e., charging a whole lot of different, unrelated charges) to help induce you to plead out on the charges they [i]really[/i] want to nail you for.
An out-of-state provider advertising for business here isn't going to subject herself to a Mann Act prosecution, no more so than a provider could be charged with "promoting prostitution" in arranging business for herself. The Mann Act originally targeted "white slavers"--interstate pimps, in other words--though the Supreme Court expanded its scope to include mere interstate adulterers and fornicators (that construction has since been voided by Congress in an amendment to the Act).
