Not sure if its appropriate to post this in this section but I found it in another section for the first time and wanted to share it great info. I am not an attorney nor the author nor do I know this person however it makes sense to me and thought it was worth sharing because sooner or later we all get stopped.

Never Lie, Never Make ANY Statements

Some people believe that if an officer doesn't read you your Miranda rights, then your statements cannot be used against you. WRONG! Miranda applies only to CUSTODIAL interrogations. So, if you are handcuffed in a police car, then the police need to Mirandize you before questioning. But, simply asking questions prior to taking a suspect into custody does not require Miranda warnings for the statements to be admissible. Police are, of course, well trained in intimidation tactics.

So, what should you do? Should you lie and say something like, "Oh, I was just giving her a ride"? Absolutely not! Never lie to a police officer because (1) false statements to LE is generally a crime by itself, and (2) your lie can be used to impeach your credibility and evince a consiousness of guilt. So never, repeat NEVER, lie to a LE officer.

The best thing to do when questioned by an officer is simply say, "With all due respect, officer, I decline to make any statements. " Or, "With all due respect, officer, I am invoking my right to remain silent. " If the cop keeps on asking questions, simply repeat that statement.

People are generally loathe to refuse to answer questions because they think that such a refusal could be construed as an admission of guilt. This is absolutely FALSE! People have a constitutional right to remain silent and refuse to answer LE questions. Thus, if you are arrested, the fact that you refused to answer questions could not even be brought up in court. The prosecuting attorney could not say to a jury, "Obviously, the defendant is guilty because he did not coooperate with police. " No, the prosecution must rely on whatever evidence they have unrelated to any admissions or refusals to talk by the defendant. In the state where I practice, to ensure that the prosecution doesn't even raise this issue, I use a device called a "Motion in Limine" prior to the actual trial (and outside the presence of the jury), wherein I ask the judge to, in essence, order the prosecution to not even make any reference to my client's refusal to answer questions. The judge invariably grants the motion, and the DA is gagged.

In short, making statements to police cannot help you, they can only hurt you. In most of my criminal cases, if my client had only kept his or her mouth shut, the police would not have had enough evidence to make an arrest, let alone obtain a conviction. And as for the threat that the SW will "spill the beans, " I would not worry too much about that (unless she is a LE decoy) because her testimony alone would probably have absolutely no credibility.

If you keep your mouth shut when encountering police, and just politely refuse to answer questions, then police and prosecution will have to rely on other evidence to convict you. Well, at this point, there's nothing you can do about that, although, your attorney may be able to spin it to your favor. However, a defendant's own statements, if legally obtained by LE, are very difficult to refute in court.

Of course, as an attorney, I should point out that the best way to avoid legal problems is to never commit any crimes. With that said, remember to KEEP YOUR MOUTH SHUT![/quote]

My thanks to Hungryeye. I though that such a refusal would be interpreted as "hindering an investigation" or some crap like that. Of course, I'll check with my own attorney, but it seems to be in the constitution. Some times stating the obvious is good thing. Even we mongers have rights.

It's been awhile, but the old lady pissed me off again. Went out looking for a familiar face checking east Dayton and on Main Street and found nothing. Guess thats two hours of my life I will never get back. Guess I'll check Craigslist.

BTW, legal technicalities are valuable, but experienced mongers know that LE will lie, mislead, and can exert big time hassle even if one is not actually charged. But it is good to know the actual legal rights. Stand your ground... unless...

Thanks for the suggestion on showing the URL where I found it. This article made a lot of sense to me as I was recently stopped in NY for speeding, when the officer gave me the ticket it noted "some" of the things I told him as we were first talking. My thoughts were this sure as hell sounds different reading it on a ticket than when we talked so I will never again engage in a conversation when stopped for anything, regardless of why they stopped me they didn't stop me because I'm their friend and they want to talk.

I was out yesterday evening around 8:00, up North Main and down Keowee. Saw nothing.

Hit the Eastside; third, fifth and xenia Avenue. Saw a nicely shaped blond on third who gave the look, but Uncle Leo was around. Circled back IO minutes later but gone.

Been a dry winter maybe Spring and the economy will bring some fresh faces.

Things like this never happen to me.

I have a client that does not trust anyone. Not vendors, not clients, not employees. So, when I arrive at their office I have to sit in the reception area until someone gets off the phone to tell someone else that I am here so that yet some one else can authorize the receptionist to let me in. This pisses me off even though the time is billable. So, now I'm sitting in the reception area. Lloyd has had not much luck lately, but chalks it up to not being able to go out at night much, avoiding some obvious areas, and being rather cautious in general. He really hates driving up and down the same road, and prefers to make big, elaborate loops. Lloyd found lots of SW's on Main, but didn't have a reasonable place to pull over or circle back around. If you can handle the risks, though, they're out there.

This was one of the most target rich environments in the Dayton area. For. 25 you could get a room with a view of every form of SW in the county. The North Plaza Inn inherited its stature when the Parkway (or Parkmore), a real dump just to the east and adjacent to I75, was closed down a few years ago. Well, we can only hope that another ho-tel will step up to fill the void. Monger that are interested may have only a month to sample these wares.

Lloyd found him a shapely, 30 some BSW on Salem one evening. As he didn't have a reasonable place to park, or a room, he settled for a quick HJ and hope for digits to set up something later. Rolled off the work path to see who was out this a.m. At 10am Main had 3, one was the 6ish at Parkwood Sunday. This morn she was solo and at Fairview. Two others were in this vacinity. Dixie had 1 near Wagner-Ford. And no one was out as I rolled thru the Eastside.

Later at 1:30p on Main there was a cracked-out thin, dark haired one, staggering around. She reminded me of one I dated 2 years ago off Dixie. I'll bet it was her. I think her motor skills are shot from X or something.

Monday night had 7 or more BSW on Main around 11pm. One of a pair was a living doll and I almost went for the swoop, but opted for a 9+ WSW that I never found. Last night east was quiet at midnight. I'm fairly new to here, but have been driving Dayton streets for a year. I saw a stacked, pretty blonde with glasses yesterday just north of the river bridge on N Dixie yesterday around 1230, and she turned up the road heading along side the river.
