An old play, but with a new twist
Yeah, this isn't anything new with the crusaders, but today's Social Network posting game is why it is such a concern. Twenty years ago, they were Private Dick wannabes, hiding in their cars, trucks and vans, with 1000,1500 and 200 mm lenses, snapping away, and posting on their FB page, but now, it's a whole new brave world, were NOTHING is private, and nothing is protected, including one's privacy.
While it is true these places are licensed (and so are the masseuses who work in them) what goes on behind closed doors is between the therapist and their client, so unless this crusader has first-hand knowledge of what takes place in such an establishment, his opinion is fair game and deserves to be questioned on camera. However, if having your puss spread all over social media with the big bold red letters "MASSAGE" over your shoulder is not something you are concerned about, by all means (and with my full endorsement and appreciation) go up and engage these so-called "do-gooders" who think they don't live in glass houses. I for one don't frequent such establishments where my face, voice and license plate can be broadcasted all over the world for people to draw their own conclusions. You are both right; to a point
While it is legal to record anyone outside in public (parks, parking lots, beaches, stores-outside, not past the entry doors) it is not legal to audio record someone out in public against their will. It is legal to "unknowingly" record their conversations and even post them "without malice" in the state of Florida, because it is all about "intent". Such a case made it all the way to SCOTUS 30 years ago, when Newt Gingrich was Speaker of the USA House of Representatives. He, AND the GOP lost that argument based on privacy, because the individuals who recorded the GOP leadership cell call, claimed they had no idea it was happening while driving down the road. Because the GOP also had no idea of the recording until it was made public by the DNC, they did not have "cause" and this was the Rehnquist court that ruled on the matter, not the far more liberal Warren Court, so keep this in mind when arguing privacy rights; here in Florida or elsewhere.
