The short form answer is that LEO could apply its obscenity or prostitution laws to arrest parties making porn, as the statutes allow for that in NC. However, they likely will never do that (although if a big porn studio moved into NC, I'd bet my ass they would hassle them relentlessly). The biggest reason they wouldn't arrest a small timer is because the Federal Appeals Courts would find for the defendant on a first amendment basis (provided you met the standard, and they would dig into the facts to determine if you were really making art), which would immediately invalidate the statutes that NC has on its books.
If they did charge you though, a defendant would have to pay a mountain of cash for his defense to make it to that point in 3+ years. It might be an effective strategy, however doing it in the open would directly break your cover. My guess is that an HSI team would still attempt to shame you by busting you and releasing your booking photo / information and then dropping the charges after it's been published (they love this tactic).
It's an interesting legal thought experiment though, and if your life circumstances aligned to offset the risks to your reputation, it could be interesting.
