MarkWa, you can say you don't agree to a search of your car and if the cops find something it might hold up in court.

But for the most part your person, your car, and your cell phone are fair game for a search. This has been tested in the courts over and over again.

Which is why they ask you if you mind if they search your car. You reply that yes, you do mind. You do not waive your 4th amendment rights.
