I haven't seen a sting before that showed a bare body in the post on CL and actual prices for the deeds listed. That would feel like entrapment to me and I would doubt it would be a sting. Can you elaborate some??

WorldsoFun is correct!

Contrary to popular wisdom Entrapment is a Defense strategy in court it is not a law as many believe.

Entrapment is when the government sets up a scenario that places an ordinary citizen in a situation that would possible cause him to break a law that normally he would not break. The Government entices him into a situation that he would not ordinarily be in.

The governments job is not to test the veracity of it's citizens.

So W.O.F. is correct if the govt. wants to set up a sting it cannot entice you with a sexy girl promising lurid acts for a fee--That would be enticing you to break the law.
When they do street stings they never put scantily clad hot babes out there, they are dressed like an ordinary woman going about her daily life. When you are arrested they will take your picture along side of the undercover officer to prove to the judge that they did not entice you in any way.

After all that rhetoric, entrapment is one of the weakest defenses available, very hard to prove and is almost never successful. So forget it as a defense if your arrested, the Govt. is too smart to get themselves caught enticing you to commit a crime and while they do it all the time they do it within the legal parameters.---VS

Enticement is legal. Scenarios for illustration. The decoy could be dressed in panties and pasties and blowing kisses as you drive by and this would not be entrapment. Same thing with a webposting. Pics could show her taking a facial and and quoting prices-- not entrapment. You are in strip bar-- dancer rubbing up and down legs and groin-- offers free lapdance-- you accept-- killer hardon from dance-- she offers to take care of problem for $10-- you accept, conspiracy to commit prostitution-- entrapment defense would likely not be accepted by the court and no instruction given.

One case (citation omitted) I recall from school, Defendant (in serious financial straits) raised entrapment and the govt admitted they offered him a supply of cocaine and shortly thereafter a buyer, (also govt) made contact with defendant looking to purchase. The transaction would have netted big bucks to the Defendant, going a long way to relieving his financial situation. Defendant took advantage of the situation and played middleman. Instruction on entrapment to jury and for their consideration not given because providing incentives, opportunity and making criminal activity just plain dam easy is not entrapment. In order to get the instruction, the Judge has to make a finding that the acts of the govt were sufficient to make the "overbearing" a question of fact for the jury.

If the entrapment is raised, the govt also gets an opportunity to prove and defend against defense by showing defendant was predisposed to commit the offense. If the defendant was predisposed, defense not available

The accurate part of the post below is that it is a defense to a charge and rarely successful. Basically you have to admit guilty-- but I was entrapped. If the defense fails, you're screwed

As far as the street stings and pictures of defendant and undercover together-- Those are mostly to prove they got the right guy and keep it easy for LEO to get the proper decoy on the proper case. The attire, appearance and actions of the decoy are of little relevance if your driving by, see her, loop and pick her up. Basically there are no govt actions to complain of.

Okay....let me ask this question since I am not a barrister or a solicitor. If LEO shows a naked lady in a post and shows a menu with pricing to entice a monger to partake, is that a legal tactic??

I recall seeing something on television about 5 years ago. A group of parole violators, deadbeat dads and bail jumpers were rounded up by mailing them a notice that said they won a prize. I think it was free Superbowl tickets if I recall correctly. When they came in to claim their tickets, they were told to go into the next room to pick them up. There police officers were waiting and handcuffs were applied.

Even if the tactic isn't legal, do you really want to be booked for something like that? That (along with drugs, diseases, guns, pimps and other like drama) is why I avoid the street. The cost to play is low, but the risk of something bad happening is much higher.

As has been noted here, everyone must be comfortable with their own risk tolerance. Some mongers go bareback and DATY with street girls for the fun factor. I wouldn't. I'm not saying they are wrong and I am right. Just that each of us must make the choice right for us based on risks vs. rewards

I belive the fact that you found a website (enticement), and went past the standard disclaimer page would go along way to show a predispostion, thus negating any claim of entrapment.

Best example of when it COULD be appropriate is a CL date (I've used this in high-bust zones up north). You schedule a massage from a CL ad and low and behold, you actually want one. She starts the LE check which you don't refuse, but you act shocked. You then she/you do the touchie thing and nature takes over. Its risky (you may too fail the LE check) but effective.

But even then its a stretch. You'd have to prove that you really didn't know CL isn't known for its patronage. That you really thought a woman's who's ad has a naked pic is just a masseuse. That massages always cost $$$. That you really thought she wanted your studly bod and not just the $$$. Imagine the bible thumpers on the jury when you explain it.
