Need Advice for caution
I was planning to ask about Dos and Don'ts on the AMP visit a few days ago and forgot about it. Now the news on [URL]www.myredbook.com[/URL] being shut down remind me to ask. There has been usage of acronym and crypt-ed massage here which has been complained and defended. I believe that the crypt-ed message help the site to be under the radar. Yet, if they are not impossibly hard for average person to find out, it won't be a big deal for the LEO to do so. However, these information will affect the AMP more than the visitor (let me know if I am wrong.).
What are the signs to look for caution? I have read in some post not to ask things explicitly but let them go naturally. So saying "full service and (just) BJ" should be safe<? After verbal agreement of full service and if she didn't do _full service_, don't insist (and don't pay the tip), just leave quietly. Is there any other advices? Thanks.

Indictment
The attorneys can weigh in on this, but the indictment is over the top. There is no way the funds being wired to and fro were solely from prostitution, they were moving millions, and I cannot believe a little dumpy website like MRB made that much. Perhaps they were actually pimping girls, taking a cut, etc. But the "travel act" (this is the federal law that makes it a federal crime to send $$$ in the mail or by wire transfer if the bucks related to a crime, essentially nationalizing crime) violation are all based on the funds being in furtherance of prostitution. I assume that any site taking a cut would want to review the indictment.

Thanks.[/QUOTE]Just remove your clothing and lay on the table without placing a towel over year. I will usually just sit on the table facing them so they can see everything. That right there tells them you're not LE. An undercover cop can't commit a crime (undressing is a lewd act) in order to arrest someone for a crime. That said, a few cops have done just that and lied about it. But the vast majority of LE run things by the book, so this rarely happens.
Once I'm undressed, I tell them exactly what I want. Which is "No massage, let's get to the good stuff. Take you clothes off and get on the table. " I'll also reach out and touch their boob or ass to give the some reassurance. If they're resistant, I leave, knowing they're too uptight or spooked to perform acceptably for me. I've rarely had any gal turn me down during this situation.

[QUOTE=DashBelli;2139575]. That right there tells them you're not LE. An undercover cop can't commit a crime (undressing is a lewd act) in order to arrest someone for a crime. .[/QUOTE]I don't know where you get this, but it is untrue.
Law Enforement is in fact even allowed to use drugs when working undercover.
Police are allowed to lie to you, to use drugs, to get naked, and even to fuck prostitutes. Note though that when they fuck a prostutite, they don't bust the prostitute. They are after the madam / pimp.
Nevertheless, the assumption that a guy pulls out his dick is therefore not a cop is absolutely, utterly false.

Get naked, maybe not illegal but WAY WAY beneath the dignity of a cop to aid what is usually no more than a misdemeanor arrest for a victimless crime. Its rarely going to happen. Keep in mind that LE's job in the system is only to gather evidence and make arrests. Prosecutors have all the discretion when it comes to filing charges and bringing cases to trial, and no prosecutor wants to try a minor crime with evidence of naked cops having sex with some desperate immigrant girl. Neither do the judges or juries want to see cases like that. So this kind of LE behavior is deterred as a practical matter and there's no glory in it.
Cops can use snitches or hired 3rd parties who can get away with what cops can't or won't do. All they need is the recorded words of contract. I. e. Solicitation of sex for money. No dicks need to be hardened and no pussies need to be penetrated. Cop fucking a prostitute: I can't claim to know for certain if its legal or not but damn close to certain that it isn't. But if a cop is going to keep his goods covered 99.99% of the time, then he's not fucking anybody for the sake of a low level arrest either. I'd like to see how a judge and jury would react to that kind of evidence in a criminal trial. That's a tainted prosecution. Not happening.
It's a different story if your Donnie Brasco undercover as a made man trying to get evidence to bring down a major organized crime family and you fuck the Don's wife to get her to talk to you. But cops fucking for minor prostitution arrests, not happening.
I recall the prosecution of strip club owner Randy Welty (Tropical Lei, Flesh, Hawaii Theatre) a few years ago in San Bernardino following a bust of Flesh which was in that city. The cops were feverishly after this guy after he had dodged prior prosecutions the way John Gotti used to do in NYC federal court. They sent in hired "private detectives" not connected to the department and they brought in the evidence LE needed, but the case was nearly upended when it was revealed that the detectives had actually had sex with dancers at Flesh. They had actually been required to promise the cops that they wouldn't take it that far and would only gather the solicitation evidence. They had the recorded "words of contract" which was all they were commissioned to obtain, but still fucked the girls and why? Because they were fucking horny, and they admitted this! The case was nearly thrown out for this irregularity, but ultimately the judge let the the case move forward and Welty was convicted.
Another factor in this case is the investigation wasn't focused on busting dancers for solicitation, but nailing Welty for essentially being a pimp. But still the legitimacy of the 3rd party gathered evidence was seriously questioned and if I remember correctly, San Berdu actually considered prosecuting the detectives for crossing the line and possibly did so. But its pretty obvious where this would have gone if it was actual police officers who were testifying and presenting media of themselves doing the deed. Point is that this kind of LE behavior is vanishingly rare and can never be anticipated as a realistic scenario.
One more little sidebar: It is illegal in California for a massage therapist to massage a customer if they are not fully "draped" on the massage table. So these MPs are guilty of at least this minor violation if they lay a hand on your back while your bare butt stares them in the face. This is the real m. O. For LE going after MPs in SoCal. They just harass them to where they can't stay in business at a particular location via a series of minor busts that don't include any prostitution charges. Not properly draping patrons, condoms on premises, unlicensed therapists or licenses not prominently displayed, et al. It has been very infrequent in these times for MP providers to actually take a bust for solicitation.

[QUOTE=MovieLawGuy;2141523]With respect, you're not entirely correct. Cops around the country fuck prostitutes all the time. Here's one example of a state trying to make it illegal to fuck in the course of an investigation and the police backlash:
[URL]http://www.huffingtonpost.com/2014/03/20/hawaii-law-police-sex-with-prostitutes_n_5003715.html[/URL][/QUOTE]I was only discussing the venue of this thread, Southern California. I don't even want to speculate about the other 49 states, Puerto Rico, Guam and the Virgin Islands! :
Also, I don't believe I asserted that I know for a fact that cops getting their fuck on is illegal and in fact stated scenarios where it very well may be legal and tolerated (that is the undercover in the mob scenario as an example. Something where the stakes are high enough to justify the behavior not to mention where the undercover's own safety may be compromised if he doesn't go along with peer pressure that comes with the undercover assignment).
My main point is that as a practical matter it isn't going to be happening in SoCal to get a misdemeanor collar on a working girl. Even if legal, prosecutors, judges and juries don't respect or want to charge and convict on this kind of evidence. It would be a scandal as it was in the example I cited involving the prosecution of Club Flesh. Cops having sex with prostitutes for a victimless crime bust leaves an intolerably unpleasant taste even in the mouths of anti-prostitution zealots. Nobody wants to see it or would condone it including ministers, rabbis, mayors, saints, polluters and environmentalists. Vice cops aren't even themselves anti-prostitution zealots, they are more typically lying hypocrites who just need the work and the funding.
When cops fuck sex workers in SoCal one of 2 scenarios are involved. The first is they are like you an I, paying for play as civilians because it's fun and makes them happy. The second are the corrupt sons of bitches who take advantage the girls by using the badge to extort free sessions, and that is a way too common scenario around here.

It does happen slightly more frequently than leap year that some local PD will take over an MP with undercovers sending all the regular workers home, and turn the joint into a TV studio to capture customer solicitation on audio and video. Nobody's getting laid to make the case. Conversations will be invited and when the poor rube on the table finally says "I'll pay $60 for a BJ" the bust is on.
It is difficult for LE to pull this off in this area because basically, they'd need to have a bunch of asian female undercovers who can do a good job faking a strong accent or pretending they don't speak English. You don't see USA born caucasians or African Americans in the local MPs, and rarely do you even see USA born asian girls, though I've known several who came here very young and were essentially raised here and accents are minimal. USA born latinas at times, but a guy usually knows what ethnicity he's going to encounter when he walks in.
If you see white or AA girls working as managers or masseuses, you've either stepped into a sting operation or maybe you walked into Massage Envy by mistake. Turn around and leave. You can be absolutely sure that undercover FEMALE cops will not get naked or allow themselves to be fondled. The most they will do with your dick is catch a usually involuntary glimpse if it can't be avoided and they can't make a deal with you before you come out of your drawers. Probably won't even massage your back if you're naked though they may insist on applying the draping as many actual working girls do until they've decided that you aren't LE.
I know some guys on this site err on the side of caution and if anything in the place seems out of whack they turn around and leave. I once decided not to make an appointment when I called a favorite AMP and the call was answered by a caucasian sounding woman who read off a list of caucasian sounding female names as the day's roster. Told her the "therapist" I'm looking for is not on her list and said goodbye. Turned out I was over cautious and the place was business as usual according to my faves. Never a bad thing to err on the side of caution, but not something you can reasonably expect to encounter. At least if you're not a believer in the chances of the Houston Astros.

LEO was using retired officers back in the Inglewood days. I sorta remember being told they paid for FS, and had it during the preliminary investigations. Of course on the day of the raid, they just recorded the magic words sex acts for money), the masseuse was already familiar with the uc so didn't hesitate, the officers swarmed.

BEWARE MASSEUSES AND MASSAGE PARLOR OWNERS OF VICE UNDERCOVER OPERATIONS.
By:** Roman P. Mosqueda, Esq.
*.
*********** The City of Los Angeles has a proliferation of* Swiss and / or Thai massage parlors. * Young Thai or Swiss masseuses do body massage on* patrons for half hour at about $30.00 to $45.00, or an hour at about $50.00 to $60.00 or more.
*********** The LA Weekly and LA Express abound with advertisings of massage parlors. * **Some massage parlor owners team up with chiropractors, who do massages in their clinics by masseuses of various nationalities.
*.
Violations of Sections 647 (b).
*On Prostitution and 316 On Keeping.
A Prostitution House Of The Penal Code:
*********** The Los Angeles Police Department (LAPD) has a Detective Support & Vice Division that conducts prostitution investigations through undercover operations on massage parlors to determine violations:* (1)* of Section 647 (b) of the California Penal Code on solicitation, engaging, and agreement to engage in an act of prostitution and commission of an act in furtherance of the agreement; and (2) of Section 316 of said Penal Code on keeping an disorderly house for the purpose of prostitution or letting (leasing) any apartment or tenement to be used for prostitution.
*********** Violations of said Sections 647 (b) and 316 of the Penal Code are misdemeanor offenses, punishable by confinement in the county jail for not exceeding one (1) year and / or fine.
*********** Section 647 (b) thereof defines "prostitution" to include "any lewd act between persons for money or other consideration. ".
*.
Typical Vice Undercover.
Operation In Massage Parlor:
************A. **Conversation With Owner:
************ Vice undercover agents are trained in prostitution arrests by attending and completing the LAPD 40-hour vice school and formal roll call training sessions specific to prostitution (punished by said Section 647 (b)) and loitering for the purpose of prostitution (punished by Section 653.22 of the Penal Code), and lewd acts in public (punished by Section 647 (a) of the Penal Code). ********.
*********** In an actual criminal case handled by this Author at the Central Arraignment Court, Department 83, the Hon. Karla the. Kerlin, Presiding, on December 17,2008, the Arrest Report states the following investigation conversation between the Officer and the Thai owner of the massage parlor:
*********** "Defendant 1 (name withheld to protect his privacy):* Hello and welcome to****************************** (name of massage parlor)!
*********** Officer (name withheld to protect his privacy):* So you guys are (name of********************************************** massage parlor) also?
*********** Defendant 1:* Yes, we are combined as one. * We really got busy here so we**************************** decided to open another location.
*********** Officer:* Good. * How many girls do you have working today?
*********** Defendant 1:* I have two (2) here and three (3) downstairs.
*********** Officer:* So do the girls do anything different at each location?
*********** Defendant* 1:* They do the same just make you happy; I will give you the new girl so you can test her out!
*********** Officer:* I don't want to waste my money for nothing!
*********** Defendant 1:* If she don't take care of you let me know I have other girls here that will!
*********** Officer:* Okay I just want half / hour today because I am pushing for time!
*********** Defendant 1:* Okay $30.00!
*********** After the Officer paid with two (2) pre-recorded $20.00 bills, and Defendant 1 handed him $10.00 change, he was directed to a room and told to wait for the new girl.
************be. **Conversation With New Masseuse:
************ The new Thai girl had just arrived from Thailand about three (3) weeks earlier. * Wearing a red blouse with a yellow top and white pants (not the required uniform for licensed massage therapists), she entered the room and stated her name. * Her name is withheld to protect her privacy.
*********** She directed the undercover officer in plain clothes to remove his clothing. * The Officer, who has Department approval to disrobe, did so. * A client of this Author, she told this Author, that the Officer was covered by a towel.
*********** The following conversation between the Officer and the new masseuse is stated in the Arrest Report:
*********** Defendant 2:* Hi, my name is.
*********** Defendant 2* spoke very little English. * (Broken).
*********** Officer:* I have very little time today.
*********************** The Thai masseuse began to massage the Officer's upper back for******** approximately 1-3 minutes.
*********** Defendant 2:* So you come here a lot?
*********** Officer:* Just when I am stressed out at work!
*********** Defendant:* Want do you want today?
*********** Officer:* What can I get?
*********** Defendant 2:* Moving her right hand in an up / down motion. * I can't do anything else because you brought.
********************************* your cell phone inside.
*********** Officer:* So, all you can do is a hand job?
*********** Defendant 2:* Moved her head in an up / down motion.
*********** Officer:* So, how much for a hand job?
*********** Defendant 2:* $40.00.
*********** Officer:* Man, $40.00 for a hand job?
*********** Defendant 2:* I am new, I need to make money!
Arrests, Posting Of Bail.
And Release From Custody:
*********** Based on the actions and statements of the new Thai masseuse and the training and experience and results of the Officer's investigation, he formed the opinion that she was engaging in prostitution and had solicited him and agreed to perform sex acts in exchange for money.
*********** The arrest team and point / cover officers were notified that a violation had taken place. * Defendant No. 1, a part-time receptionist, who took the place of the owner who had left earlier after his conversation with the officer, was arrested for retrieving money, offering sexual favors, and having knowledge of the activity at the location, under said Section 316.
*********** And Defendant No. 2, the new Thai masseuse, was arrested for prostitution under said Section 647 (b). * Defendant No. 1 posted $500.00 cash bond and was released from custody; and Defendant No. 2 posted $2,000.00 cash bond, and was likewise released.
Arraignment Of Defendants No. 1.
And No. 2 At Central Arraignment.
Court (Departments 81 and 83):
*********** This Author was informed by the bailiff in Department 81 that the name of Defendant No. 1 was not in the court calendar for December 17,2008. * A check with the criminal law clerk at the Clerk's Office revealed that no complaint was filed by the City Attorney against him.
*********** Indeed, Defendant No 1 was and is not the owner of the massage parlor, only a part-time receptionist. * He was wrongly arrested. * The City Attorney apparently rejected the recommended charge under said Section 316. *****.
*********** Defendant No. 2 was charged with a Misdemeanor Complaint by the City Attorney, with Count I of loitering in a public place with the intent to commit prostitution under Section 653.22 of the Penal Code and Count II of soliciting, engaging, and agreeing to engage in prostitution under said Section 647 (b).
*.
Plea Bargaining And Sentencing.
Under Section 647 (h), Penal Code:
*********** This Author, informed the Deputy City Attorney assigned to Department 83 that his Thai masseuse client had told him that:* (1) the Officer tried to get her consent to do a hand job, but she refused; (2) she hardly speaks English, only three (3) weeks in the United States at the time of the incident; and (3) she has no prior arrest nor conviction.
*********** This Author also discussed the immigration consequences of conviction for prostitution, a crime involving moral turpitude, which the client insisted did not occur, with the Deputy City Attorney.
*********** Considering that it would be her word against that of a Vice Officer, and that the jury would likely believe the Officer over a Thai tourist, unlicensed masseuse, she agreed to plead no contest to the crime of loitering in a private property under Section 647 (h) of the Penal Code, not a crime involving moral turpitude, for no jail time, 24 months of summary probation, 10 days of Caltrans community work with two (2) days of credit, stay away from the massage parlor, aids education, and $245.00 of court fines.
*********** The understanding Deputy City Attorney agreed to the no contest plea to the added Count III, and dismissed Counts I and II. * The Thai masseuse was sentenced accordingly by Judge Karla the. Kerlin.
************(The Author, Roman P. Mosqueda, is a past participant of the Trial Advocacy Program (TAP) of the Los Angeles City Attorney's Office, a member of the California Public Defenders Association, and has practiced criminal defense for over twenty (20) years* in California.).
