I think the courts may make a distinction between audio and video recording. With audio, you could be on the phone so there may be no way of telling where all participants are, therefore you need their permission to record no matter what. Most laws governing video recording are predicate on the location. Meaning are you on a public street or are you in the privacy of someone home / office with a hidden camera. If you are in the confounds of your home, most states afford you the expectation of privacy.
This is why news crews are often broadcasting from sidewalks outside homes, because the sidewalk is considered public property and they need permission to video from an owner to video on private property. But these guys are on public streets or private property that is not owned by the monger being videoed. So it is my layman's opinion that if you are videoed you have little recourse and you might even get yourself a trespassing charge on yourself.
Bottom line, these guys can video on public streets all they want without permission. So just be very careful with running to the police to launch a complaint, you just might get yourself in a different jam.
