The process bears a remarkable similarity to traffic infractions. Technically yes, there's a process by which citizens can contest speed traps. But the whole process heavily favors the other side.
Last April, a camera in Alexandria took my photo going 7 or 8 mph over. Despite going with the flow of traffic (and later trying to play it off like my ticket was lost in the mail), they were determined to get their pound of flesh. So I insisted on a court date. Here's the catch: owing to the early ravages of COVID back then and the massive backlog of cases being processed, they refused to give a set date & time to show up. According to them, contesting tickets meant going [U]every single day the court was available[/U] over a 30-day period, pray that my specific case number got called, and then present a defense.
As you can imagine, this created a whole mess of problems. Any day in which I'm not called up is another day wasted. I'd have to try again the next day, and the next, and the next. And when you live an hour away from the courthouse & work full-time, it's not like time is a luxury one can afford to waste--and that's what authorities count on. Wasting your time until you're frustrated and just pony up the green or plead guilty. Additionally, DC is one of the few places in the country which doesn't require a cop to show up to court, nor does it require a traffic camera's maintenance log be shared until the day of court.
So yes, you can technically fight traffic tickets or solicitation charges. But lordy does the deck stack heavily in [I]their[/I] favor. And I don't see that changing any time soon.

He should have taken the plea deal unless he simply wanted to exercise his right to present a defense. What was his defense, that he was the cable guy or room service? The fact that he paid a lot for a lawyer means nothing, of course he was going to take the job.

They did punish you for making them try the case though. A lawyer friend explained it to me. If you went to court to fight a traffic ticket, you might beat it. He would recommend you go ahead and plead it out unless he was positive you would win your case, because lets say the fine would be $250. Well if you tried to beat it and did not win your case, then he said it was funny, but it would cost you twice as much or $500 if you lost. He mentioned a number of other crimes including solicitation of a prostitute that would cost double if you lost your case instead of pleading it out. He said in most cases it was just not worth taking the chance.

I have been to court many times over my 72 years of life and always came out better by having my day in court, not in Maryland anyway. Penalties are applied by judges not prosecutors, at least in my cases. My last episode the the wanted me to do time for being beaten by a cop, he called it assault, I was found guilty and given time served for the hours in central booking. This included the failed drug possession charge the the had to drop. No one punished me for pleading innocent and not taking the 30 days and 2 years probation plea deal. Being on probation causes more trouble in a man's life than doing 90 days, what with possible violations. I love those bible belt states with their harsh laws for "sinning" or having fun.
I was driving down to Miami and before leaving I was warned of a town in Georgia whose name started with a "K" and sure enough driving through without of state tags got us pulled over. You have to exercise extra care in Jim Crow states.
