Why would you even believe they have to tell you?[/QUOTE]IF the officer is on duty and enforcing the law and asked if he is a cop he MUST admit it, however he can avoid the question or steer away from it. BUT if he is a part of a sting and is on duty work in his official compacity he MUST advise that he is or try to avoid the question in some way. If he claims to not be a cop and flat out say "No I am not a cop" then makes an arrest it will be considered entrapment and the charges will eventually be dropped but I am sure not after some publicity which would not look good for you either. If the cop is off duty he does not have to say he is a cop, However if that is the case he can still make an arrest even off duty. Use this example, a cop walks into a strip and ends up in the back and is asked to do the do he can legally make an arrest even off duty. There is well established case law out there on the entrapment in cases such as this. All you need to do is google it you will find many.

Keep it straight. Cops can lie, they don't need solid evidence to convict, and the state does not have to prove entrapment, you do. And will most often fail.
If you have opportunity, search out the cases of "Operation Working Woman I" and "Operation Working Woman II", two of several stings in Florida several years back. They are classics.
The idea of entrapment is that the police go out of their way to entice someone to do something they have no prediliction to do without any enticement.
In the first case, the entrapment case was used by many of the lawyers as the undercover officer approached the gents and solicited them for sex (against the advice of the prosecutor who told the PD and the Decoy to specifically NOT approach the Johns to avoid any chance of an entrapment plea).
Other actions we also done by the decoy also drove questions of false entrapment. For instance, the evidence used against the "johns" was an audio recording of them soliciting. In almost all of the cases, apparently it did not record any words from the "johns". Only the decoy was heard relatively plainly. So there was little evidence of the suspects consent.
So frame this in your minds, the decoy approached, solicited, and there is ZERO evidence those arrested solicited her for sex except for the word of the decoy alone who broke the rules layed down by prosecutors own office. The defense lawyers fought it vigorously and the result of 32 cases in the first operation...[b]98% conviction rate[/b].
Entrapment is incredibly tough to prove, and the state has zero -initial- burden disprove entrapment. The defense has to prove overwhelmingly that it was a case of entrapment. The largest clear path to proving entrapment in any kind of case is to prove that the state was "overly involved" in the creation of the crime you admit you did. For prostitution, that the cop forced you, threatened you, and went out of their way to make you solicit her. Good lawyer i$ required since they are the ones to sell the case. Meanwhile, you go through all of the hell and recieve scarlet letter across your backside.
With all that said...do you really want to beleive the myth that any case of entrapment can be blown up simply by asking her "Are you a cop"? Really? Feel free to do it, as its a salve, but nothing replaces common sense and keeping the big head in charge at all times.
Of also interesting note: A gent who was arrested in the first sting was walking the neighborhood some months later and noticed the Operation Working Woman II sting in progress. He walked around the block, found the police cruisers "hiding" and spotted them. He pointed and laughed at them, and they responded back the same. Moments later, he noticed a potential john about to get stung. He approached the gent about to get stung and warned him off, yelling "She's a cop! She's a cop". He was arrested. Humorous.
