I don't want to continue an endless banter about this topic, so this will be my last post on this issue. I apologize if my first post wasn't clear because It seems like you said almost the same thing anyway.
Hopefully this post will be clearer than my first one. A first prostitution offense and 2nd prostitution would be treated as a misdemeanors. A 3rd prostitution offense would be considered a felony charge. This is how the Florida statute reads. It doesn't matter if the probation is ended or not on the previous charge (s).
In other words, under current Florida law, a streetwalker cannot have 10 charges for prostitution that are 3 years apart and have them all be misdemeanors (just because she is not on active probation). Unless someone REALLY screws up when filing the arrest report.
Now, are there situations where an arresting officer makes an error and arrests a streetwalker and charges her with a felony incorrectly (like on a 2nd offense for example)----sure. I have seen this happen on a couple occasions when reviewing records for some girls. These are isolated incidents, though. In these situations, any public defender with a pulse will be able to have that charge corrected before it goes in front of the judge.
When you were talking about the whole probation issue, it seems like the level of edification provided to you by your streetwalker friend led you astray a bit. Based on your earlier post, I thought that she (and you) may have been confused because she was on probation and got arrested again and thought that is why she had a felony charge. This is what I had attempted to clear up for you both. You had stated in your earlier post that:

I think this is where you and your streetwalker friend may have got confused. The legal system is not designed to put people on probation so that a new charge can be 'upgraded'.
Obviously, a lot of this legal stuff can get complicated, and I can understand if you don't take my word for it. My advice would be to call one of the lawyers in the yellow pages anonymously and ask them about these issues. They will verify these exact same facts for you. Otherwise everyone is just going to keep going around in circles on this topic which has about played itself out at this point.
