Providers often don't get arrested unless they are also involved with drug use or distributing. In fact, about year ago statutes were presented to some state legislatures to make Prostitution legal for women but Johns still get subject to arrest. I have not heard of the state statutes that you suggested are being proposed, but I can tell you it would not pass constitutional muster. You can't have a crime when the underlying act is legal.
