Even if they are the police they are going to say no. Same thing if a SW asks a guy in the car if he is le, if he is undercover he will say no.
Where in the world did this unban legend come form that suggests that by asking the question,"Are you associated with law enforcement" or "Are you a police officer" somehow requires them to answer honestly. Likewise, all these disclaimers in some ladies' ads, guess what, no protection under the law.
Of course, the police will state that they are not LE. They are allowed under the law to do that. What they are not allowed to do is say "will you blow me / fuck me for $100 (name your price)! They have to get the "magic words from the hobbyist or provider for there to be a criminal offense.
Of course, the Defense Attorney can attempt to make a big deal out of any misrepresentation by the Police, but it is generally not effective, unless it is a very naive jury. Of course, these cases are unlikely to go to trial anyway.
