This is particularly the case now since the statutes were changed this past July. That said, it is easier for a prostitute to get charged with a felony even on a first arrest if the prostitute gets charged with more than one sex crimes offense. That isn't always all that hard to do.
As another posted commented, there are aggravating circumstances under which a first offense can pull a felony charge. It isn't the only circumstance and I underscore that the amended statutes also affect this.

A recent poster asked about the possibility of getting charged with a felony on a first arrest. My advice to anyone doing a BYOC move is that you put the condoms somewhere NOT ON YOUR PERSON. If the police raid the establishment upon determining that it is a place of prostitution, and you are caught with a pocket full of condoms, then you can get arrested and charged with "patronizing a prostitute". As of last July, that charge is now a felony.
Not to be too alarmist, though, because if it is a first time offense, you would almost certainly get "deferred prosecution", which is potentially a highly intrusive form of supervision where you would likely have to do stuff like community service and going to "john school" (where you sit and listen to lectures about the evils of prostitution and sex addiction). If you get through the period of "supervision" without any other offenses, then there is no further prosecution. But if you don't clear the period of "supervision", you could then be looking at a felony prosecution.
Just something to think about. As always, never rely upon comments made in this forum for legal advice and always seek the advice of an attorney.
