But prosecutor's can use circumstantial eveidence in a criminal case against you; text messages material to the charged offense may be deemed relevant and admitted into evidence. Now if you take evidence of your text messages, plus evidence uncovered from material the booker stored, things may get a little dicey. And in the end, it may be true that charges will ultimately be dropped against you, but it is not as black and white as your comment makes it seem. An over zealous prosecutor may very well still move forward with the matter, and then it's a matter of connecting the dots.
